Thank you for entrusting Parties by Design with one of the most important aspects of your wedding day. To ensure that we provide you with a stress-free event, including an affordable, delicious, high quality confection, we want to make sure we have accurately covered everything with you.
This Contract: Every effort has been made by Parties by Design (�PbD�) to thoroughly and accurately represent the understanding between PbD and the client. The client is solely responsible for carefully reading this contract information and apprising PbD of any and all changes, errors, and omissions. PbD will not be responsible for any changes to this contract given orally or by external document and not noted in this contract. Your wedding cake order form, and order forms for any other items, once signed, becomes part of your contract. Deposit and Payment: A non-refundable 50% deposit on the total contract investment is required upon the signing of the contract. Your order may not be decreased once the contract is signed, but increases in your order are possible with notice. Balance is due no later than two weeks (14 days) prior to the wedding, payable by cash or check. Balance can be paid as late as five (5) business days before the wedding, with cash or certified check, and a surcharge of 30%. Failure to pay by this time will result in loss of deposit and cancellation of contract. Returned checks will assess a fee of $25. In this event, if proper payment in full is not received by 10 days prior to the wedding, this contract becomes null and void. |

If the contract is being signed less than 10 days prior to the wedding, the total contract investment is due in full, in cash or certified check. Disputes: In the event of a dispute arising from this contract, the venue for the resolution of the dispute shall be Davidson County, Tennessee. Attorneys Fees: In the event that PbD is required to undertake legal action to collect payment, the client agrees to pay reasonable attorney fees and court costs. Delivery & Setup: Deliveries are determined on an individual basis, but as a general guideline, those within a several mile radius of Downtown Metro Nashville are $35. The same deliveries to outer-lying areas (Bellevue, Priest Lake, Hickory Hollow, Old Hickory, Franklin, Brentwood, Clarksville, etc.) are $40 and up, and are quoted on an individual basis. Equipment: Rental charges and refundable deposits for the cake equipment (fountains, stands, plates, pillars, columns, toppers, etc) are specified and included in your contract. It is the client�s responsibility to see that these items are returned, undamaged, within seven (7) days of the wedding date (also the �return by� date and time on the contract/order form). Failure to do so will result in forfeiture of full deposit. Equipment deposits are 100% refundable when contract is fulfilled. ANY damage to equipment will result in full deposit being retained as reimbursement. Flowers: Because of the hazards and safety issues involved, adding fresh flowers to the cake is at client�s request and discretion. Your florist, per your written request, may do so onsite. PbD is not responsible for any illness or injury resulting from the use of fresh flowers on the cake. Tasting and Consultations: PbD is happy to provide a sample of the cake you are considering. With a week�s notice, a tasting for two can be arranged. Should additional �tasters� be necessary, a small cake can be prepared for $10 (buttercream) or $15 (rolled buttercream or ganache). This cake will be representative of the cake flavor and icing choice, and not a replica of the actual wedding cake. Additional Charges: The following are extra: transporting cake up stairs ($20 per flight, $30 if not noted in contract in �other�); site being distanced from parking area ($20, $30 if not noted in contract in �other�); representative not there at specified time to receive cake ($25); accessories, such as pearls, lace, beading, netting, ribbons, etc (as quoted); cake cutting and serving ($35). A complimentary cake-cutting guide will be provided upon request. Cancellations: Cancellations must be made in writing to PbD, and we will do everything possible to work with you in rescheduling in this event. Your deposit, although non-refundable, can be applied toward other orders or events within 30 days of your cancellation. Any equipment deposits will be refunded 100% once we receive your written notice. |
