Respected Sir,

I have repeatedly send emails on the growing problem of unauthorized or illegal use advanced high-tech spy devices (cameras, snooping devices, Electromagnetic emission devices) which track A-Z of any person’s activity – speech, writing, bodily movements, computer and web usage (cyber-stalking) etc, even in darkness – from a considerable distance away.

Use of these devices is becoming a common feature among ordinary people, for criminal purposes, stalking, eavesdropping on other’s private activities, vocal conversation, telephone conversation etc – in gross violation of

1.       the Supreme Court ruling on wire-tapping/illegal surveillance

2.       IT 2000 law prohibiting computer hacking

These devices are latest advances in technology; making both the Supreme Court ruling as well as the IT law “outdated” in comparison.

There is no way an ordinary citizen can build evidence for court submission, when confronted by these invisible “covert” monitoring; unless and until an undercover investigation is launched by the Central Intelligence.

There are a lot of “educated” criminal elements indulging in nefarious

activities, which many an educated commoner assume as impossible theoretically,

“No, not in India, may be in some western nations”

 

We have an assumption that an educated person usually minds his or her own

business. But as we move around in society, we find a major contradiction. A lot

of people with mental abnormalities – a pervert condition to intrude into

other’s private matters, even without permission. Certain areas of technological

advancement fuel the poor mental state.

 

I quote below a few links on the use of tiny, moth-ball sized spy cameras, night

vision, optical, wireless devices etc as well as the installation of similar spy

devices inside computers for clandestine monitoring and surveillance.

 

These are the days of global village. Any person can buy any type of snooping

device through the internet, and use them for furthering their selfish illegal

needs”. Such snooping devices are not only manufactured in USA, but also in

many other countries like China (Reference: 1) and smuggled elsewhere for

clandestine purposes.

 

Use of such devices is prohibited in USA. Are there equivalent prohibition laws

in India?

       Isn’t high time to get those devices banned in India and its state

territories?

       Isn’t high time for laws prohibiting stalking, cyber stalking, and privacy

violation on behalf of such snooping devices to be introduced in India and its

state territories?

 

Many a street stories abound, even in far away places like Bangalore (Margosa

Road, Sampige Road and other places), Thiruvananthapuram (Ambuja Vilasom Road

and other places), of the rampant use of such spy devices, for eavesdropping and

surveillance on other’s privacy, by stalkers and criminal elements.

 

Over a period of time, with the help of such devices for clandestine monitoring,

a detailed SWOT (Strength, Weakness, Opportunity, and Threat) could be done by

any criminal element on any unsuspecting man or woman. Using such a SWOT

analysis, any man or woman could be blackmailed to submission (with naked

photos, private secrets etc), to further one’s criminal interests. With the help

of spy devices,

       Imagine the scenario where a chaste house-wife or a chaste mother or a chaste

sister being blackmailed for money or sexual favours, with naked photos or

private secrets by an outsider, without the knowledge of the men in the family?

       Imagine the scenario where a man in a family is blackmailed for money or

“official secrets” or something similar with naked photos or private secrets of

his chaste house-wife or a chaste mother or a chaste sister by an outsider,

without the knowledge of other members in the family?

 

Under such circumstances,

 

1.      What is expected of the victims who suffer mental trauma and agony on being

observed or watched clandestinely – spy devices in bedroom, toilets etc?

(undressing, nakedness, etc. In short, live pornography!)

2.      Where should the victims approach for redress of their grievances of this

immoral” nature?

3.      What sort of punishment exist in the present legal setup for such perverted

voyeurs who violate one’s privacy, nakedness etc inside one’s own house, with

the use of such spy gadgets?

4.      What sort of compensation or damages exist in the present legal setup for the

victims who suffer mental harm, defamation, privacy violation, computer hacking,

stalking, cyber-stalking, done with the help of spy devices?

I quote below a few links on the use of tiny, moth-ball sized spy cameras, night vision devices etc as well as the installation of similar spy devices inside computers for clandestine monitoring by criminal elements in India. Use of such devices are prohibited in USA.

 

Are there equivalent laws in India?

 

These are the days of global village. Any person can buy any type of snooping device through the internet, and use them for furthering their selfish illegal “needs”.

 

Are such devices banned in India?

 

Many a street stories abound, even in far away Thiruvananthapuram, of the rampant use of such devices, for eavesdropping and surveillance on other’s privacy, by stalkers and criminal elements.
