                                                                            ARTICLE 1 - Definitions

Unless the context indicates otherwise, the following terms shall have the following definitions:

1.1 
Architectural Review Committee.  The Architectural Review Committee described in Section 7.1.

1.2 
Articles.  The Articles of Incorporation of the Association an any amendment thereto.

1.3
Association. Mission Park of Santa Clara Homeowners Association, a California nonprofit mutual benefit corporation.

1.4
Board.  The Board of Directors of the Association.

1.5
Bylaws. The Bylaws of the Association and any amendments thereto.

1.6
Common Area.  Lot S as shown on the Map and any additional common area lots that may be subsequently annexed into the Development as described in Article 13 and Exhibit A, including the Recreational Lot.

1.7
Declarant.  First American Title Guaranty Company, a California corporation, or any successor or assignee that assumes in writing the rights and duties of the Declarant hereunder.  The beneficial owner of the Property, SCS Development Co., a California corporation dba Citation Homes Central, shall exercise all the rights and perform the duties of the Declarant hereunder.

Declaration. This Declaration of Restrictions (CC&R's) and any amendment or corrections thereto.

1.9
Development. The residential development that is constructed on the Property and made subject to this Declaration, including the Residential Lots, the Common Area, and all improvements thereon.

1.10
Governing Documents.  This Declaration, the Articles of Incorporation, the Bylaws and the Rules.

1.11
Improvements.  Any fixture affixed to any Lot or Common Area in the Development within the meaning of Civil Code section 660.

1.12
Lot or Residential Lot.  Lots 23 through 32 and 52 through 69 as shown on the Map and Improvements thereon, any additional Residential Lots that may be subsequently annexed into the Development as described in Article 13 and Exhibit A and any Improvement thereon.

1.13.
Map.  The subdivision map entitled "Tract No. 8815" filed for record in Santa Clara County, California, on September 27, 1996, in Book 682 of Maps at pages 23 through 27 and any additional recorded maps that describe any lots or common area that may be subsequently annexed into the Development as described in Article 13 and Exhibit A.

1.14
Member. A member of the Association.

1.15
Mortgage. A recorded mortgage or deed of trust against one or more Lots in the Development.

1.16
Mortgagee.  A mortgagee under a Mortgage or a beneficiary under a deed of trust recorded against a Lot in the Development.

1.17
Owner. The record title owner or owners of a Lot in the Development.

1.18
Person. Any natural person, partnership, corporation or other legal entity.

1.19
Private Driveway.  The Common Area shown on the Map as private driveway and subject to the easement designated "Private Driveway & P.U.E." on the Map.

1.20
Private Driveway Lot or Lots. Each Residential Lot in the Development that is adjacent to a Private Driveway as shown on the Map for ingress and egress to and from the Lot.

1.21
Property. The land and improvements shown on the Map.

1.22
Recreational Lot.  The Common Area designated "Lot S" on the Map.

1.23
Rules. Rules or regulations adopted by the Board from time to time pursuant to the authority of Section 5.6(ii).
