DECLARATION OF COVENANTS,
CONDITIONS AND RESTRICTIONS FOR
LAKEWOOD CROSSING, SECTION ONE

 

THIS DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS, made as of the date hereinafter set forth by Cypress Creek Properties, Ltd., a Texas limited partnership, and Harry J. Glauser, III (hereinafter collectively referred to as the "Declarant").

 

WITNESSETH:

 

WHEREAS, the Declarant is the owner of the approximately 75.9689 acre tract of land in Harris County, Texas which has been platted and subdivided as Lakewood Crossing, Section One, a subdivision of land in Harris County, Texas according to the plat thereof recorded under Film Code No. 384143 in the Map Records of Harris County, Texas (the "Subdivision"); and

 

WHEREAS, the Declarant intends by this Declaration to impose mutually beneficial restrictions under a general plan of improvements for the benefit of all owners of the property within the Subdivision and the undersigned desire to provide a flexible and reasonable procedure for the overall development of such property and to establish a method for the administration, maintenance, preservation, use, and enjoyment of such property.

 

NOW, THEREFORE, the Declarant hereby declares that the property within the Subdivision is hereby subjected to the provisions of this Declaration and such property shall be held, sold, transferred, conveyed, used, occupied, and mortgaged or otherwise encumbered subject to the covenants, conditions, restrictions, easements, assessments, and liens hereinafter set forth, which are for the purpose of protecting the value and desirability of, and which shall run with the title to, the real property subject to this Declaration, and shall be binding on all persons having any right, title, or interest in all or any portion of such property, their respective heirs, legal representatives, successors, successors-in-title, and assigns and shall inure to the benefit of each and every owner of all or any portion thereof.
