AMENDMENT TO DECLARATION OF COVENANTS,
CONDITIONS AND RESTRICTIONS FOR
LAKEWOOD CROSSING, SECTION ONE

 

THIS SECOND AMENDMENT TO DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS, made as of the date hereinafter set forth by Cypress Creek Properties, Ltd., a Texas limited partnership, and Harry J. Glauser, III (hereinafter collectively referred to as the "Declarant").

 

WITNESSETH:

 

WHEREAS, Declarant executed that certain Declaration of Covenants, Conditions, and Restrictions for Lakewood Crossing, Section One (the "Declaration") dated June 5, 1997 and filed under County Clerk's File No. S-486360 and recorded in the Official Public Records of Real Property of Harris County, Texas (the "Official Records"), which imposed restrictive covenants on certain property described therein; and

 

WHEREAS, the Declaration was amended by that certain Amendment to Declaration of Covenants, Conditions and Restrictions for Lakewood Crossing, Section One dated September 5, 1997 and filed under Clerk's File No. S-635194 and recorded in the Official Records; and

 

WHEREAS, as a result of the agreement by the U.S. Postal Service to provide individual residence mail service to Lakewood Crossing, Section One, Declarant desires to amend the Declaration as hereinafter specified pursuant to Section 5 of Article IX thereof as the owner of more than fifty percent of the Lots subject to the Declaration; and

 

NOW, THEREFORE, Declarant hereby declares as follows:

 

1. Section 17 of VII of the Declaration is amended and restated to read as follows:

 

"Section 17. MAILBOXES AND ADDRESSES. The Owner of each Lot shall install an individual mailbox on his Lot in accordance with the requirements of the U.S. Postal Service and this Section. Unless or until such time as the Architectural Review Committee prescribes alternative specifications for mailboxes which must be complied with, or unless otherwise approved by the Architectural Review Committee, the mailbox installed by an Owner on his Lot must either be a black mailbox mounted on the top of a 4 inch by 4 inch cedar post or be installed within a brick and masonry structure. No decorative embellishments or other similar features shall be installed on a mailbox. Each Owner shall maintain his mailbox in an upright vertical position at all times and immediately repair any damage. Each Lot shall have a house number identifying its street house number identifying its street address made of materials and a color or colors specified by the Architectural Review Committee in keeping with the overall character and aesthetics of the community."

 

2. Except as expressly amended by the First Amendment and hereby, the Declaration is not affected hereby and the same is ratified as being in full force and effect.

 

IN WITNESS WHEREOF, this Amendment to Declaration of Covenants, Conditions and Restrictions is executed as of the 12th day of December, 1997.
