On January 10, 2000 Mr. Bob Schupbach provide me with the attached information that he obtained
from Sue Lackey with the UNL Geological and Natural Resources Surveys. This information was
generated by UNL at the request of Mr. Schupbach who has concerns with the potential impact to
Verdigre Creek from the proposed livestock waste control facility for the TeVelde Dairy. He
commented to me that the soils at the Test Hole #20-A-57 and the soil probe performed at the lagoon
site are basically the same. The sands below the proposed lagoon will act as a wick and any lagoon
seepage will quickly discharge to the surface in Verdigre Creek, thus polluting the creek. He
contends that we should be utilizing our authority in LB822, specifically Section 54-2404(3)(c) which
states that the department may deny or restrict an application for a permit regarding a transfer or
modification of an existing permit based upon the potential degradation of a cold water class A
stream.
