I, William Warner of Wethersfield, do make this my last will and testament: I give to my beloved wife Elizabeth, of my estate, both real and personal, one-third part while she remains my widow, and no longer. I give to my eldest son John Warner my house, barn and homelott, containing 10 acres, with the trees, fence and other buildings thereon growing and standing, sd. homelott being butted and bounded on the Beaver Dam or brook east, on the highway leading to Middletown west, on land which I bought of Joseph Rily north, and on land of Joseph Grimes south; and also 4 acres on the west side of the aforesd. highway, butting and bounding east on sd. highway, west partly on comon and partly on land of
William Blin, north on land herein given to my son Jonathan, and south on land of Joshua Robbins; also I give to my son John Warner 2 acres of my land I had of my brother Daniel Warner, lying in the Great Meadow, which was Porter's land, butted and bounded east on a highway, west on the Great Plain, north on Eliz: Warner, and south on land of John Coleman. Also 2 acres in the Great Swamp, butted and bounded east on the Great River, west on a highway, north on land of Daniel Warner, and south on land of William Stilman. Also 4 acres in the Great Meadow in a place called the Nook, butted and bounded on a highway west and south, and on the Beaver Brook east and north. I give to my son William Warner several pieces of land: 6 acres of land at a place called Hangdog, 2 acres of land in Beaver Meadow. Adjoining proprietors: Capt. John Chester, heirs of Samuel Wollcott decd., Eliphalet Dickinson, Ebenezer Belding, Jacob Williams, Capt. Robbins, heirs of Israel Crane, Isaac Rily, Noadiah Dickinson, Jacob Griswold, Samuel Benton and Nathaniel Boreman. My will is that my children which I had by my first wife have all that land which came to me by her, lying in that tier of lotts next to Farmingtown line, that it be equally divided amongst them. I give to my 3 daughters, vizt., to Mary, Hannah and Abigail Warner, to each of them �80 paid to them out of my moveable estate. What my daughter Mary hath already had, and an �8 right in the 52-acre lott which I bought of Elijah Crane, I give to my sd. daughter Mary and to her son Elisha Dunham, to be a part of ye sd. �80. I appoint my son John Warner and my brother Joshua Robbins executors. I do desire my brother Thomas Welles and my brother Daniel Warner and Mr. Richard Robbins to see this my will executed. Page 63--4 March, 1711-12: This Court appoint Patience Nott of Wethersfield to be guardian to her 3 children, minors, viz., Abraham, Thankfull and Anne. Page 64--4 March, 1711-12: Adms. exhibits now an account of their Adms. Allowed. Order to dist. the estate:� s d To Patience Nott, widow, 40-02-04To John, eldest son, 125-19-09To Jonathan, William, Nathaniel, Gershom, Abraham, Thankfull and Anne Nott, to each, 62-19-10 1/2 And appoint Capt. Robert Welles, John Curtis, Jr., and Benjamin Churchill distributors. And grant Patience and John Nott a Quietus Est. Page 198 (Vol. X) 21 August, 1728: Ann Nott informs this Court that her father, John Nott the 2nd, died intestate about 18 or 19 years ago, and an invt. exhibited in Court, debts paid, and an order to distribute. The distributors set out to each child so many pounds in value, but did not set out each child's part by meets and bounds as they ought to have done. The children have by consent given the widow Patience Nott liberty to improve the whole of sd. lot ever since the sd. dist. Now the sd. Patience Nott, being willing to improve her part separately, moves this Court that sd. lot of land be set out to her and the rest by meets and bounds, to the end that she may know which is her particular part to improve. This Court appoint Benjamin Churchill, Jonathan Burnham and Capt. Robert Welles to set out by meets and bounds according to a former dist., allowing the widow to improve a third part of each child's portion. Page 202--1st October, 1728: John Nott moves this Court that the home lot of his late father, John Nott, might be set out to him, he paying the rest of the heirs their portions according to just value. Page 85 (Vol. XI) 13 March, 1732-3: Thomas Harris and
William Blynn, in right of their wives Thankfull and Ann, heirs to the estate of John Nott of Wethersfield, moves this Court to set out the home lot of the decd. by meets and bounds to the respective heirs, according to an order of the Court, 4 March, 1711-12. And it appears to this Court, by the sd. distribution, that the sd. home lott was not divided to the heirs by meets and bounds, and now appoint Jonathan Belding, Jacob Goodrich and Jonathan Burnham to set out, etc. John Nott, the eldest son, appeals to the Superior Court.
Page 8 (Vol. XIII) 31 May, 1737: Patience Nott, widow, showing that her husband had been many years dead, yet there had not been set out to her any right of dower in the real estate, this Court now appoint Nathaniel Burnham, Gideon Wells and Elizer Goodrich to set out to her 1-3 part of the land by meets and bounds.
