Entertainment Agreement

THE PARTIES: This Agreement is for mobile disc jockey entertainment services for the event described below, between the undersigned client and Absolute Entertainment.

PAYMENT TERMS: Total fee agreed upon by Client and Absolute Entertainment is $000.00; tax included. A 5% discount may be applied if the total fee is paid at the time of signing this agreement. Absolute Entertainment is holding a tentative reservation for the Client's event until the above "Response Date." To confirm this Agreement, return one signed and completed copy along with a deposit of $100.00 or the total fee minus the 5% discount BEFORE THE ABOVE RESPONSE DATE. Agreements received after the Response Date will be subject to availability. If sending a deposit, the balance may be paid no later than two weeks prior to the event by check or cash. The balance is due no later than the date of the event unless otherwise previously arranged and may be paid with the aforementioned check or cash only. All checks should be made payable to Jesse Barto. There will be a $20.00 fee charged for all returned checks. Gratuities are given to a Disc Jockey at an event are made at the sole discretion of the Client.

CANCELLATION: This Agreement cannot be canceled or modified except in writing by the Client or Absolute Entertainment. If Client initiates cancellation less then 60 days prior to the event, then the deposit will be forfeited. For cancellations less than 30 days prior to the event, Client is responsible for the total fee OR may forfeit deposit only by signing a new Entertainment Agreement with Absolute Entertainment within two weeks of cancellation for a substitute engagement performed in the following six months. Rescheduling for events canceled due to inclement weather shall be accommodated whenever possible. Rescheduled events are subject to availability.

OVERTIME COSTS: When feasible, Client requests for extended playing time during event will be accommodated. Overtime requested may be made n half-hour increments at a cost of $00.00 per half-hour. Payment for overtime is due on the date of event, and may be made with cash only.

DJ PERSONALITY: Client's choice of DJ Personality is offered on a first come, first serve basis. If a specific DJ is not selected, Absolute Entertainment will assign an available DJ best suited for the event. If by unavoidable circumstance, your scheduled DJ Personality is not available to perform on the date of your event, Absolute Entertainment shall substitute a DJ Personality of similar experience.

PREVISIONS: Client shall ensure that: (1) performance facility provides Absolute Entertainment with a sturdy covered table approximately 2 x 8 feet in area with within 25 feet of a 110-volt outlet (3 prong grounded); (2) facility is open at least one hour prior to scheduled start time; (3) facility meets all federal and state safety regulations and has all appropriate music licenses and performance permits; (4) reasonable steps will be taken to protect Absolute Entertainment's equipment, personnel, and music, and crowd control will be provided if warranted; (5) for outdoor performances, shelter is provided that completely covers and protects Absolute Entertainment's equipment from adverse weather conditions; (6) DJ and all related Absolute Entertainment staff shall be provided with one hot meal each to be consumed at the time of event.

Client accepts full responsibility and is liable for any damages, injuries, or delays that occur as a result of failure to comply with these provisions. In the event of circumstances deemed by DJ to present a real or implied threat of injury or harm to DJ, equipment, or recordings, then DJ reserves the right to cease performance until such time as Client resolves the threatening situation. DJ further reserves the right to deny any guest access to recordings or equipment. In the unlikely event the DJ's performance is delayed, liability is limited to providing Client with performance time equal to time lacking.

Please retain a copy of this Entertainment Agreement for your records. SIGN BELOW AND RETURN COPY, ALONG WITH $100.00 DEPOSIT OR TOTAL FEE MINUS THE 5% DISCOUNT BEFORE THE RESPONSE DATE.
