Welcome to JPDetroits Workers Rights Column
Once again, why should I listen to you, JP?
Well, second of all I live in Michigan the home and creator of the Workers compensation laws and regulations that would lead the rest of the nation to enact such protective measures for the corporations and companies that did not want to be sued for the damages inflicted upon their employees due to there own negligence and disregard for their employees safety and health rights. Just pay for the doctor bills that they consider necessary to get you back to work regardless of your condition.
Should I trust a lawyer to make decisions?
Well, while many lawyers may give you straight forward advice many others may not. Speak to as many as possible prior to making that decision. utilize their initial "free consultation" to gage how you should proceed, thus the advice to speak to several.
Why could this be?
Lawyers like insurance companies as well as your employer are in buisiness to make money and sometimes they are money driven. That being said you should be very cautious. Are they looking out for you or themselves, find out before signing on.
Once again how do I protect myself?
You should gain the information that your state has regarding workers compensation and always stay off "the line" of being uncooperative and do not try to circumvent the rules and regulations. knowledge is power and the more you have the better off you are. I will have some links to give you an idea. The insurance companies have a lot of control of the situation so make sure you have very, very detailed notes and documentation. Keep this info as organized as possible and take down every time and name as well as what was said by you and them. They will always have convienient amneisia when it comes to what the realities are. They can dipute anything you say so you better be prepared to dispute them in a reasonable and organized manner.
Why again is the system like this?
I can only figure that since its inception at corporations initial expense workmans comp. has evolved by their ability to steer legislators and laws through special interests and a whole lot of money and resources as a group and not individually.
How can this be legal?
Because it was bought and paid for by corporations. And to this day they dictate to the legislators how to proceed. polititians need donations, corporations give lots of money!
