| Should I assume that the workers compensation laws will protect me? | ||||||||||||||||||||||||||||||||||||||||||||||||
| The short answer is, NO! Workers compensation was initiated and created to PROTECT employers from injured employees. | ||||||||||||||||||||||||||||||||||||||||||||||||
| Should I accept the clinics diagnosis and risk further injury? | ||||||||||||||||||||||||||||||||||||||||||||||||
| Once again, NO. If the clinic says there is nothing wrong, yet there is you do have the option to seek advice from your own doctor. You do however need to follow to the letter of the law regarding this matter or dipute. The clinic knows who pays them and will act accordingly. | ||||||||||||||||||||||||||||||||||||||||||||||||
| What if the Workers Compensation carrier disputes your injury? | ||||||||||||||||||||||||||||||||||||||||||||||||
| Well you must, once again, follow the laws in place to dispute and seek another doctors advice and/or diagnosis. Time is NOT on your side! Remember the Workers Comp. carrier is a for profit entity and they have unlimited resources to wage war against you. They also have far greater knowledge as to how to dipute and deny your claim, as well as how to make you look like someone who wants something for nothing. My advice is to get as many opinions via the states rules and regulations and get legal advice from more than one source. DO NOT institute litigation (a law suit) until all other avenues have been exhausted. The one thing insurance companies love is to here that you have spoken to a lawyer or that a lawyer contacts them regarding your claim. The retaining of counsil prior to attempting to resolve through the proper procedures will in effect put you at a great disadvantage. Your benefits will most likely result in result in the termination of those entitled benefits and potentially cost you your job as well. | ||||||||||||||||||||||||||||||||||||||||||||||||
| How long can this process take? | ||||||||||||||||||||||||||||||||||||||||||||||||
| Unfortunately this process may take a long time. I must say again that time is not your friend. Also I must say that as your life becomes difficult diring the war waged against you, this is a distinct advantage for your case manager. He/she will still be eating well, sleeping well, enjoying their life as usuall and continue to recieve their paycheck and their benefits of employment. You will be starved out or become desperate enough to fall into their traps, allowing them to suspend or terminate your benefits. | ||||||||||||||||||||||||||||||||||||||||||||||||
| Why can they do this to me? | ||||||||||||||||||||||||||||||||||||||||||||||||
| Simply put----> Because they can and are encouraged by their management to do so. | ||||||||||||||||||||||||||||||||||||||||||||||||
| What should I do? | ||||||||||||||||||||||||||||||||||||||||||||||||
| Be very cautious and patient. DO NOT give them any ammunition to battle you! | ||||||||||||||||||||||||||||||||||||||||||||||||
