In California, if a person dies leaving more than $100,000 worth of estate, whether he or she has a will or intestate, the decedent's estate will probably have to be probated in the state court.

Since California is also a "community property" law state, there are certain special community property rules on how to dispose of a deceased spouse's estate.

The California probate law gives the surviving spouse several expedite procedures to obtain the titles of decedent's real or personal properties.
