Adam, along with brother Joseph, wife Sarah and children Robert, Rebecca and Dianna emigrated to Kentucky circa 1792 and settled in the Pottinger�s Creek settlement near Bardstown, Nelson County.
In 1802 Adam Fogle was convicted of the murder of his wife Sarah and served a sentence of two years at the Kentucky State Penitentiary in Frankfort:


In a State Publication, printed in 1860, entitled "A Report on the History and Mode of Management of the Kentucky Penitentiary, from its origin, in 1798, to March 1, 1860" compiled by William C. Sneed, there are the following references to Adam Fogle:

p. 42 -- Prisoner Number 5:  Adam Fogle born in Maryland, Occupation - Farmer, Age - 43, County:  Nelson

p. 73 -- Adam Fogle Crime:  manslaughter; County sent from:  Nelson, Year: 1802; Term of sentence:  2 years


At a Court called and held for Nelson County at the Courthouse in Bardstown on Tuesday the third day of August 1802
For the examination of Adam Fogle charged with the murder of Sarah Fogle wife of the said Adam Fogle on the Friday week before the 25th of July 1802  on the  _____ day of July last

The prisoner being set to the Bar in the Custody of them and it being demanded of him whether he is guilty or not guilty of the charge aforesaid, says he is in no wise guilty and thereupon sundry witnesses were sworn and examined and the said Adam Fogle the prisoner at the Bar heard in his defence on consideration thereof and on argument of Counsel on both sides the Court are of opinion that the said Adam Fogle ought to be tried before the next Supreme Court to be held for the district of Bairdstown and thereupon he be remanded to jail and ordered to be sent accordingly and thereupon Charles Haden and his wife Francis Rice Joseph Thompson and wife, Elizabeth Briant Raphael Spink, Wilford Mudd, Robert Fogle, Rebecca Fogle, Joseph Fogle & John Young came into Court and acknowledged themselves severally indebted to his excellency James Garrard Esq. Governor of Kentucky for the time being and his successors each in the penalty of one hundred pounds of their respective goods chattle, lands and tenements to be levied and to his excellency or his successor rendered yet upon this condition that if they and each of them�
Tuesday October 19th 1802

Adam Fogle who stands Indicted with Murder was led to the bar in custody of Jailer and being thereof arraigned pleaded not guilty to the charge aforesaid and of this he puts himself upon the Country and the attorney General in behalf of the Commonwealth likewise and thereupon came a Jury towit Micajah Roach  William Marshall, John B. Hill, Saml Pottinger Saml McAdams, John Donohoo, Griffith Willett Leonard Johnston, John Johnston Jereboam Brown John Vowles & Walter Burch who being duly sworn delivered a verdict in these words towit �

Adam Fogle late of the County of Nelson (farmer) who stands indicted of murder was led to the bar in custody of the Jailor and thereof arraigned and pleaded not guilty of the indictment and for his trial put himself upon God and his Country and the Attorney General on behalf of the Commonwealth likewise.  Whereupon came a Jury towit, Micajah Roach, William Marshall, John B. Hill, Samuel Pottenger, Samuel McAdams, John Donahoo, Griffith Willett, Leonard Johnston, John Johnston, Jereboam Brown, John Vowls and Walter B__ Burch who were elected tried and given the truth of and upon the premises to speak

Ordered that Court adjourn until Tomorrow morning nine O Clock

This day came the Attorney General and the prisoner being led to the bar the Jury sworn on the second day of this Term returned a verdict in these words towit, �We of the Jury do find the prisoner Adam Fogle guilty of voluntary man-slaughter and do decide and assertain that he undergo confinement in the Jail and penitentiary house for and during the term of two years according to Law.
