Thursday 5th September 1799

On the motion of Adam Fogle to obtain a Judgement against James Horton late sheriff of Washington County and John Hayes Mordecai Lincoln Rhodam Parrot Benjamin Pile and John Dowdall as sd Horton's securities, for the balance due on an Execution sued out of this Court by the plaintiff against George A. Hamilton Leonard Hamilton and Samuel Grundy late sheriff of said County, came the parties by their attornies and on the motion of the defendants the motion aforesaid is continued till the third day of the next Court at the Costs of the said Defendants

Saturday May 11th 1799:

On the motion of Adam Fogle against James Horton Sheriff of Washington County.  This day came the Plaintiff by his attorney and its appearing by the affidavit of John Rowan that the Defendant hath had legal notice of this motion he was solemnly called but came not.  Therefore it is considered by the Court that the Plaintiff recover against the said Defendant twenty two pounds ten shillings with interest thereon to be computed after the rate of fifteen p centum p annum from the third day of August 1798 until the time of payment being so much received on an Execution sued out of this court by the Plaintiff against George Hamilton, Leonard Hamilton, & Samuel Grundy Sheriff of Washington County which was ___ by Samuel Richards the Defendants ___ and costs of this matter



We the subscribers do oblige ourselves our heirs & C. to pay or cause to be paid unto Adam Fogle his heirs or assigns the sum of Ninety four pounds Eleven Shillings & six pence current money of Kentucky on or before the 25th of October next.  As witness our hands & seals this 25th of Apl 1796

The Commonwealth of Kentucky to the Sheriff of Washington County greeting.  We command you to take George A. Hamilton and Leonard Hamilton -------------------------

if they may be found in your bailiwick and them safely kept so that you have their bodies befour the judges of our Supreme Court for Bairdstown District on the third day of the present September term at the courthouse in Bairdtown to answer Adam Fogle in a plea of debt for ninety four pounds eleven shillings and six pence damage twenty pounds

and have then there this writ, witness Benjamin Grayson clerk of our said court at the courthouse afore'd 4th day of September 1797 in the 6th year of the Commonwealth

Adam Fogle complains of George A. Hamilton and Leonard Hamilton in custody & of a plea that they render to him the sum of ninety four pounds eleven shillings & six pence current money of Kentucky which to him they owe and from him unjustly detain.  For ___ ___ that the said Defts on the 25th day of April 1796 at the Parish of Kentucky in the District aforesaid and in the County of Washington by their writing ___ ___ subscribed with their hands and sealed with their seals the date when of is the same day and year aforesaid and which is hereto the ______
to pay or cause to be paid unto the Plt aforesaid his heirs or assigns the sum of ninety four pounds eleven shillings & six pence current money of Kentucky on or before the 25th of October next ensuing the date aforesaid for ___ ___.  Nevertheless the said Defts ___ often ___ have not paid the said sum of ninety four pounds eleven shillings & six pence or any part of the same according to the time of the writing of ___ aforesaid.  But the same to pay have altogether ___ and still do refuse to the damage of the Plt ___ ___ bring his suit ___
