James R. Dickey, Administrator & als vs. George Prior & Others. Henry M. Prior died at his residence in Giles Co., in 1864, testate. He left widow Susan and eleven children: Eliza Jane Wisdom, George W. Prior, Gracy, wife of Daniel Petty, Nancy H., wife of R. W. Dickey, Aaron L., Mary E., Rufus A., Frances F., Marion F., Louisa and Samuel G. Prior, the last six of whom are minors. Henry N. Prior was the owner of a 230 acre tract of land in the 5th Civil District on Ham's Creek. He bought this proberty from Levi Tucker. People claiming to be Creditors against estate of Henry N. Prior. E. T. Fry, Guardian vs. J. C. Burgess, Administrator & als. John H. Terry died in testate in Giles Co, in 1885, leaving surviving his widow, Kate Terry and his children: Mary, Addie, Ella, John, Maude, Henry and Zack T. Mary married John T. Cross in May 1889. Addie, Ella, John, and Maude were minors and John W. Wisdom qualified as Guardian with M. C. Fitzpatrick and J. W. Wilsford as his Surities for the sum of $5,000. Mr. Wisdom made his last settlement Oct. 30, 1889 where there was a balance due of $2,321.93. Wisdom and his Surities were liable for the amount plus interest. J. W. Wisdom died intestate in 1890 and J. C. Burgess was appointed as the Administrator of his estate. The estate of J. H. Terry was wound up in the County Court of Giles County in the cause of C. T. Orr, Administrator vs. H. W. Terry & als. Mary Terry married John T. Cross in May 1889. Henry W. & Zack Terry lived in Marshall Co., TN. They were not to share in estate as they had already gotten share. John Morgan Nix married Addie Terry. John Terry married Florence Nix. Sarah J. Moore vs. J. C. Moore. Sarah J. Moore by her next friend, her niece and heir, Virginia A. Peden. Sarah J. Moore did not have the mental capacity to attend to her ordinary or business affairs. Sarah J. Moore acquired 193 acres of land in the division of lands of William P. Moore, her father. This land lay in the 12th District. The land was bounded North by Solomon Simmons & the Williamson Place, East by J. C. Moore, South by Milt Williams, West by Mrs. John W. Wisdom. She and the Defendant were owners of a tract of 63 3/4 acres of land in the 16th District. Sarah J. Moore never married and spent her life in the vicinity and most of it spent on the 193 acres as that was the homeplace of William P. Moore. For many years the land was in control of her brother, J. C. Moore. Virginia A. Peden said J. C. Moore had not been fair with his sister. That she had not gotten what she deserved from her land. Virginia A. Peden wanted J. C. Moore enjoined from the collection of rent and from renting land out. She wanted land sold. J. R. Thomason & wife, Mary vs Mat. Faught & als. J. R. Thomason & wife, Mary of Maury County, TN vs Madison & William Faught. Plaintiff represented that Mary Thomason was the owner of a tract of 163 acres of land situated in the 5th District. This land was deeded to Mary Thomason by J. W. P & Francis Walker of Maury Co., TN and registered in Deed Book 00, page 33. The land was rented to Defendant Madison Faught for the years 1880-1883 but made no contract for the year 1884. The Faughts cut and sold valuable timber from the land and owed money to the Thomasons. Both Defendants were wholly insolvent and worthless. The Complainants sued the Faughts to recover the tract of land. J. R. & Mary Thomason asked that a Writ of Injunction be issued to restrain the Faughts from cutting and removing or selling or in any way disposing of any trees, timber or any other materials on the premises and a Receiver be appointed to control and manage the land, that Decrees be rendered in favor of Mary Thomason for damages to land and timber. Depositions by Matt Faught, John Buchanan, James Chapman, J. R. Thomason, Washington Walker & others. The land in question belonged to Lee H. Wisdom. Lee H. Wisdom died leaving his widow and four children who moved to Polk Co., AR after the Civil War. The land belonged to George Walls before Lee H. Wisdom. Robert Dickey was to rent and manage property for Mrs. Wisdom, he being her brother-in-law. J. R. Thomason & wife, Mary, sold the land to Matt Faught and his heirs this being Jan. 4, 1883. it was decreed by this Court that the land be divided between Madison Faught & J. R. Thomason & wife. Madison Faught received 78 acres and Thomason received 82.8 acres. The land was situated on Muckle Branch. This was the second Decree by Court. The land was surveyed this Feb. 17, 1888. R. P. Yancy was the Commissioner appointed by Court. A Deed from George L. H. Wisdom of Polk Co., AR to J. R. & Mary Thomason in this case. A big controversy between Madison Faught & others over 163 acres on Muckle Branch, 5th District, Giles Co., TN. Madison Faught had lived on the land for many years.
