APD: Money for nothing

The Austin Police Department receives money from the Department of Justice (via Governor Rick Perry's office) for assistance for female victims of domestic violence." I believe they should give this money back.



Texas law states that victims of family violence are "entitled to the the maximum protection from harm or abuse or the threat of harm or abuse as is permitted by law.


When I broke up with my live in boyfriend  he attacked me.  I called 911.  Officers Diane Leija, Stephan Barnes, and Officer Perryvore responded.


The police report states, “He decided to run her off by getting naked and annoying her to the point where she would leave... If he touched her at all it was incidental and he was simply trying to harass her. ”    To protect the white man who tried to rape me APD Officer Diane Leija fabricated that I said this was not attempted sexual assault.  Isn't the purpose of the  FBI Uniform Crime Report for police officers to classify crimes?


I looked at the FBI Uniform Crime Report.  Here’s the examples it gives under forcible rape or an attempt to forcible rape, from the FBI 2004 UCR guideline page 20:

"The following scenarios illustrate incidents known to law enforcement that reporting agencies must classifyas Attempts to Commit Forcible Rape (2b): 4)  A man attacked a woman on the street, knocked her down, and attempted to rape her.  A pedestrian  frightened the man away before he could complete the attack.

5)  At a local bar, a man slipped gamma-hydroxybutyrate (GHB), a date rape drug, into a woman’s drink.  However, the man was unable to lure the woman away from her friends.  Investigators concluded that the man intended to have intercourse with the woman and arrested him.

The description Officer Leija provided in the police report falls under attempted sexual assault. I guess the misclassification of the crime helped Austin appear to be the " 3rd safest mid-sized city”


Somehow, the officers did not arrest him for attempted sexual assault, false imprisonment, or public indecency.


APD family violence policy states that:


neither the arresting officer nor the detectives in felony arrests can drop charges."


The officers drove away and left me with the man who had just tried to rape me. Then, a false police report was written that cleared him and criminalized me. We all agreed that I was the victim. How is this following APD policy to protect any potentiel victim of family violence?  How is this following state law to provide me maximum protection? 


Instead, Leija states in the police report that I'm calling on my cellphone trying to get help as the officers drive away.  Why did I need to call anyone else after I had mobilized the APD family violence protection team" with my 911 call?

For your claims to be considered, you should show more of the document. The facts of the incident are all blacked out so how are we to know what you are talking about?

Some facts aren't blacked out. The first document clearly shows that I was the victim. It shows the statement that the suspect made to Officer Leija. Why he took off his clothes. The remaining sections show that Officer Leija changed him to my roommate instead of live in boyfriend.
