HB 160 currently before the Illinois House Elementary and secondary Education Committee and likely to be voted on next Wednesday, 9, requires that the Illinois State Board of Education may not adopt any rule beyond what is imposed by the U.S. Department of Education regulations in carrying out the recently-passed federal Individuals with Education Act (the new IDEA). If it is enacted, HB 160 will eliminate critical protections for students with disabilities that are currently spelled out in ISBE rules but are extremely unlikely to be specified in federal regulations (such as limits on class sizes for students with disabilities).
