WILL OF EMANUEL CARPENTER


LANCASTER COUNTY, PENNSYLVANIA WILL BOOK D (Vol.1, p.8); 1780


In the Name of God Amen. I Emanuel Carpenter of Earl Township in the County of Lancaster and State of Pennsylvania Esquire being in Health and of sound mind and Memory thanks be unto God therefore I do hereby mak and publish this my Last Will & Testament in Manner and form following that is to say in the first Place I order & direct that all my Just Debts and funeral Expences be paid and Satiffyed. Item. I give and devise unto my son Jacob Carpenter all that plantation and tract of Land Whereon he now dwells adjoining to the Lands of Henry Carpenter John Carpenter Christian Garber Jacob and Michael Weidler and other Land hereby Given to my Son Emanuel Containing two hundred and twenty one acres be the Same more or lefs according to a Draught thereof to be held by my said Son Jacob his Heirs and Afsigns forever upon Condition that my said Son Jacob his heirs Executors pay to Adam Regart and Catharine his Wife in three years After my Decease but if Catharina my Wife fhould survive me then in three years after her decease the Sum of Six hundred pounds lawfull Money of Pennsylvania and also pay to Catharina my said yearly & Every Year during her Natural Life the sum of twelve pounds Lawfull Money as aforesaid. I give and devise to my Son Emanuel Carpenter all that Plantation and tract of Land whereon he now dwells adjoining to the Lands of Henry Carpenter Michael Weidler and the Land hereby given to my son Jacob containing two hundred and twenty one acres be it more or lefs according to a Draught thereof Made to be held by my said son Emanuel his heirs and Afsigns forever Exepting and reserving unto my said Son Jacob and to his heirs and Afsigns is the Right & free priveledge of the rise and Benefit of the Water Course and ditfh Mad on the fouth East fid on Emanuels Meadow for the use of my said son Jacob to water his Meadow on the south side of Caneftoge Creek two Days in Every Week forever he my said son Jacob his Heirs and Afsigns Bear and be at the Proportionable part of the Costs and Charges in maintaining and upholding the said ditfh and water course forever and Also upon contion that my said son Emanuel or his heirs Executors pay unto my Daughter Elizabeth Graff the sum of six hundred Pounds Lawfull Money of Pennsylvania in three years after my decease but if Catharina my said wife fhould survive me then in three years after her decease and also find and Allow to my said wife fufficient Bread butter and Milk for her and a maid if She Chooses one to Live With her during Life and I do Also Order and direct that my said Wife Shall have the free Use and Pofsefsion and priviledge to Live in that house Wherein we now live in With part of the Cellar and wash House under it and the Garden adjoining the said house my said Son Keeping the House in Good repair during her Life and hall dung into the Garden sufficient to maneure the same. Item. I give and bequeath unto John Gibbance and Elizabeth his Wife My granddaughter the sum of Eight hundred pounds lawfull Money of Pennsylvania to be paid to them or Either of them as far as conveniantly maybe after my decease out of my personal Estate. I order that my said Sons fhall have and use the Carpenter and joiners tools with a big Crofs Cut Saw a Crow Barr & pair of big Stilyards Between them I give and bequeath to my son in Law Adam Reigart the sum of fifty Pounds to be paid out of my Personal Estate and all the remainder and Residue of my Estate whatsoever I may or fhall die Pofsefsed off, I give and bequeath to Catharina may said Wife to dispose thereof as fhe thinks proper and lastly I do hereby nominate and Appoint Catharina my said Wife Executrix and my Son in Law Adam Reigart Executor of this my last Will and Testament hereby revoking and making null and void all former and other will or wills by me at any Time heretofore made declaring this to be and contain my last will and Testament in Witnefs whereof I have hereunto set my hand and Seal the twenty fifth day of September in the year of our Lord one thousand seven hundred and seventy nine.

Lancaster County fs. The 31st of May Anno Domino 1780. Personally appeared before me the Subscriber Abraham Forney and Peter Forney two of the Subscribing Witnefses to the above Will and on their Solemn Affirmations according to Law did declare and Say, That they were present and saw & heard Emanuel Carpenter the Testator Above named Sign Seal Publish Pronounce and declare the foregoing writing as and for his last Will and Testament and that at the doing thereof he was of sound Mind Memory and Understanding to the best of their Knowledge Observation and Belief.

Be it Remembered that on the thirty first of June Anno Domino 1780. The Last Will and Testament of Emanuel Carpenter late of Earl Township in the County of Lancaster Esquire deceased, was proved approved and insinuated in the form of Law, and Letters Testamentary thereon were granted to Christina Carpenter the Widow of the decd. and Adam Reigart the Executors therein Named. They being first duly Qualified well and truly to Administer the Estate of the said decedent and exhibiting to the Register's Office a true Inventory thereof on or before the 31st of June next and to render a true account of their Administration on the said Estate when thereto Lawfully required.
