2.3. ESO Lawyer’s (?) tricks and the lies in Tribunal to win the lawsuits

only a short essay:
First of all, an Organisation is defined by the ILO Administrative Tribunal Statute always as DEFENDANT.
This
fact shall give to the reader already the idea of an UTMOST DISCRIMINATION and of an UTMOST PROTECTION, that an ORGANISATION
shall receive anyway by the JUDGES of the TRIBUNAL, since by principle an Organisation
(read “its failing directors”, see also FOREWORD AT BEGINNING OF THIS HOME PAGE)
can never be DELINQUENT, i.e. ACCUSED SUMMONED PARTY, but ONLY DEFENDANT.
This fact happens always, as if a Complainant,
instead of being by her/his action A SEEKER OF PROPER LABOUR RIGHTS BY A TRIBUNAL
(moreover BY BEARING VERY HUGE COSTS FOR A COMPLAINT) would be a mad in attacking
an impeccable BODY, that on turn must have legally only the chance to be “defendant”.
To balance this DISCRIMINATION and where applicable,
we will use thus hereby also the verb “summon” for an Organisation.
Therefore, the CLASSICAL ARGUMENTS of an Organisation
(read also: “of its LAWYERS”), that
is summoned for BREACH OF LAW (Accused Party), FOLLOW GENERALLY THE SEQUENCE:

- COMPLAINT NOT RECEIVABLE FOR EXPIRATION OOF TERMS
The
Organisation instead of honestly defend itself against moved charges, tries
immediately to bar the TRUTH by demanding the irreceivability of the Complaint
for questions of terms.
Then,
when the Complaint is receivable

- COMPLAINT NOT RECEIVABLE BECAUSE UNFOUNDEED IN LAW
When
an immediate liquidation of the Complaint is impossible, since breaches are
evident
3. – ORGANISATION IS NOT GUILTY
Then, in presence of evident and proved Organisation’s liability:
4. - THE COMPLAINANT IS GUILTY (generally with statements like “He
did not Appeal”)
Then, when a Complainant surely cannot be guilty:

- TO LIE
Then,
when the LIE cannot be sustained by true facts and witness:

- TO DEFAME THE PERSON OF THE COMPLAINANT
Then,
when her/his reputation is in no way blameworthy:
7. - TO EXTOL POWER AND PROMINENT IMAGE OF THE ORGANISATION, OF ITS FAMOUS DIRECTORS OR OF ITS SUPPORTING NATIONS AGAINST THE COMPLAINANT (WHO MAY BE ALSO PICTURED IN TRIBUNAL AND IN PUBLIC LIKE A POOR CRAZY FACING GLORIOUS FAME)
Then,
when a Complainant cannot be considered at all CRAZY, but, on contrary, intelligent
and hard:
8. - TO TRY TO OBSTRUCT THE JUSTICE (ALSO BY POWERFUL POLITICAL “FRIENDSHIPS”)
When
the obstruction (or the powerful political friendships) somehow also fails for
Complainant’s obstinacy:
9. - TO PAY, but not the Complainant for demanded remedy and justice, instead…for trying to find more flexibility by a Tribunal (in fact and by principle, the Complainant must lose any trial, if hopefully he does not die before, otherwise this would be a humiliating defeat for the Organisation)
When
also a corruption may not have the hoped effect:

- TO TAKE TIME AND TO TRY TO CONSIGN THE CAASE TO OBLIVION
ALL
ABOVE SEQUENCE WE ALSO FIND, IN WHOLE OR IN PART, IN MR. PALMA JUDICIAL CASES.
The reader may find other slightly changed sequence or other not so classical arguments, but, on last instance, either THE COMPLAINANT COMES TO THE DEMANDED JUSTICE, OR HE MUST EXPRESS, AFTER SO MANY YEARS OF TRIALS, SOMEHOW LIKE GALILEO GALILEI (1564-1642) “…but it does move ”, i.e. “the story will make justice of you, criminals, should I be unable to get it in the course of my life”.
But,
Mr. Palma (ESO shall know) is neither an astronomer nor a Galilei,
who was regretfully, also the father of all the abjuration in Astronomy: everybody
knows that on the last he thought only of his personal interests, for a shorter
blind and prisoner life, in spite of the TRUTH NOTHING ELSE BUT THE TRUTH in
astronomy. This was unfortunately the obscure side of Galilei and example today
for possible black sheep
in Astronomy, who also avail themselves of this science, but only for getting
their welfare and their personal interests, instead of striving with courage
for the TRUTH AND FOR THE HUMANITY ALSO IN THIS DISCIPLINE.
Mr. Palma (ESO and everybody shall know) is instead a man of courage and of principles, who will strive at any rate for the Truth and for the Justice, because of received unfairness at ESO, up to the last minute of his life…and ESO has only one thing to do to save its IMAGE BEFORE OF THE WORLDWIDE ASTRONOMERS AND FOR ITS LONGER GOOD HISTORY: TO RENDER FINALLY JUSTICE!
Anyway, the author begs your pardon, if unable to better develop immediately this sub-section: the arguments will be better re-presented more systematically as soon as possible, also evidencing the real tricks and lies rendered by ESO.
