Case in which Circuit Court Judge Andrew N. Frye, Jr., returned custody of a child to an abusive situation. The child was reportedly beaten by his mother's boyfriend, the child suffered damage to his eye which led to blindness in one eye, and was alleged to have been sexually abused by the mother's father. Case was reversed and remanded with directions.

FAMILY: Legal Custody Returned to Mother

HAGER v. HAGER,

No. 31325 (Per Curiam)(Davis, J., dissenting)(McGraw, J., dissenting)(November 21, 2003). Reversing a ruling by the Circuit Court of Lincoln County regarding legal custody of a child. Holding that the lower court's finding that the mother's fiancé was dangerous to the child is contrary the evidence. Remanding for prompt and peaceful effectuation of a change in custody.
