    Military conscription violates the Thirteenth Amendment of the Constitution of the United States. Consequently:
  • All convictions for evasion of conscription, or failure to register for conscription, are bereft of legal basis and are hereby pardoned. All fines for these offenses shall be repaid. All disabilities imposed for these offenses shall be lifted. All persons imprisoned for these offenses shall be freed.
  • All convictions of a conscript for desertion, disobedience or absence without leave are bereft of legal basis, and are hereby pardoned. All fines for these offenses shall be repaid. All disabilities imposed for these offenses shall be lifted. All persons imprisoned for these offenses shall be freed.
  • The Selective Service Bureau is bereft of legal authority. It is directed to immediately destroy all of the registration records it maintains, without delay.
  • All foreign persons in the United States, who would be subject to immediate involuntary induction into the armed forces of their nation of citizenship should they return thereto, are hereby granted asylum to remain in the United States.

    The Constitution of the United States does not empower the Congress to legislate on any of the following matters:
  • The preservation of wetlands and/or endangered species;
  • The production, sale, and use of narcotics, stimulants, depressants, hallucinogens, and other drugs;
  • Wages and working conditions;
  • Emission and fuel efficiency standards;
  • The size or organization of corporations.
    The Tenth Amendment reserves the power to legislate on these matters to the states, thereby prohibiting federal legislation. Consequently, all acts of Congress on these subjects are invalid ab initio, with the following consequences:
  • All investigations into violations of these acts shall immediately cease;
  • All records prepared in accordance with these acts shall be given to the subject party, who shall be permitted to dispose of them as it pleases them;
  • All charges for violating these acts shall be immediately dropped;
  • All persons convicted for violations of these acts are hereby pardoned;
  • All property seized for non-compliance with these acts shall be immediately restored;
  • All fines imposed for violations of these acts shall be immediately refunded.
    Any official of the United States attempting to enforce these invalid laws may be treated as a common criminal behaving in the same manner.

    It is my intention to fully enforce the right of all accused persons to trial by a fully informed jury. Pursuant to this objective, I will pardon all offenses lacking an identifiable victim tried under any of the following conditions:
  • The jury is not informed of its power to nullify unjust laws or is told that it lacks such power, or any effort is made to exclude or remove jurors disposed to nullifying the law;
  • Any element of the offense tried is established without the unanimous agreement of the jury thereto;
  • A juror's request to put a question to the prosecution is refused, or the prosecution's answer is not the whole truth.
  • A defendant's right to trial by jury is denied for any reason, except consensual waiver by the defendant subsequent to notification of indictment.

    The Constitution of the United States does not empower Congress to maintain any system of public recreation or natural reserves.
    Property taken from citizens in order to create any nature reserve or public recreation facility of the United States shall be restored. All other properties shall be given to the states within which they lie.

    Personnel in basic military training will be segregated according to gender. They will be trained at separate installations where the ability exists. If separate installations are not available, recruits will be housed in separate facilities, and training and other actions will be arranged to minimize contact between trainees of opposite gender.
    The sole criterion for promotion in the military shall be merit, specifically, the projected ability to perform the duties required of personnel in the grade to which promotion is considered. This projection shall be based on objective measurement of knowledge, objective measurement of performance in the present duty position, and objective measurement of experience. Records used by promotion boards at any stage of the decision-making process shall identify the candidate by service number only, and shall be free of any data that indicates the gender, race, ancestry, or religious preference of the candidate.
    The policy of permitting senior military personnel to retire in lieu of formal prosecution creates the appearance of preferential treatment, and is terminated immediately. Retirement of personnel facing investigation for criminal wrongdoing shall be approved only when completely cleared of all wrongdoing by the investigation. Retirement of personnel facing criminal prosecution shall be approved only upon acquittal of all charges.
    The integrity of the complaints process is vital to good order and discipline in the armed forces of the United States. The definition of reprisal is hereby extended to include all unfavorable official action taken in retaliation for any communication of a grievance. Every report of reprisal shall be fully investigated. Every substantiated instance of reprisal shall be prosecuted by court-martial.

    I have concluded that the current policy on personal relationships between members of the armed forces of the United States is absurd.
    Personal relationships between members of the armed forces of the United States are matters of official concern only when there is a potential for detriment to good order and discipline (DGOD), and are unlawful only in those instances where DGOD actually occurs.
    DGOD will be presumed only if the senior person has the authority to directly exercise favoritism or preferential treatment of substantial benefit or harm towards the junior person in any official matter, or if the relationship constitutes adultery. Otherwise, DGOD must be substantiated by events of the following nature:
  • The senior person attempts to obtain preferential treatment for the junior person in any official matter.
  • The junior person invokes the senior person in order to obtain preferential treatment in any official matter.
  • The senior person uses, or threatens to use, his or her position in a coercive manner against any person in order to begin or continue the relationship.
    The mere fact that the two partners to a relationship are of disparate grades–even if one is a commissioned officer and the other is enlisted–is not a matter of official concern, and absent events of the aforementioned nature will not be grounds for official action.
    I will be giving this matter my attention during my term of office. If it is demonstrated that this relaxation of policy directly endangers good order and discipline, it will be reversed.
