Article 38(2) of the Statute of the International Court of Justice, Article 38: 1. The Court, whose function is to decide in accordance with international law such disputes as are submitted to it, shall apply: a. international conventions, whether general or particular, establishing rules expressly recognized by the contesting states; b. international custom, as evidence of a general practice accepted as law; c. the general principles of law recognized by civilized nations; d. subject to the provisions of Article 59, judicial decisions and the teachings of the most highly qualified publicists of the various nations, as subsidiary means for the determination of rules of law. 2. This provision shall not prejudice the power of the Court to decide a case ex aequo et bono, if the parties agree thereto.

de Landa offers a contrast to Hardt and Negri’s use of Deleuze,because he believes Marxism to be a dead end. Apart from that his ontologysounds interesting in that it is based on the notion that the world is madeup of individuals – only differing on the basis of economies of scale –and each the result of a specific individuation process. The Ctheoryinterview has
some interesting stuff on this point – although there’s a lot ofcomplexity theory stuff to wade through. The economies of scale basis for individuation would seem to bypass the argument of individual vs community which tends often to be the ultimate outcome when thinking aboutAboriginal communities.
