If we rent our facility to someone else, does our insurance cover the rental event?

This is probably the single most often asked insurance question I get. And for five years
my answer has always been, No!

But suddenly I feel like I have landed in the middle of a production of Fiddler, singing
wonder of wonder, a miracle, a miracle.

The Ponta, Castle & Ingram Agency recently completed
successful negotiations with our principal insurance carrier so that you will
now be able to add liability coverage to your AACT-endorsed insurance
policy when you rent your theatre to others.

* There will be a per diem charge for the additional coverage and such coverage
will be subject to certain stipulations and conditions.

* The additional coverage will not be available if there is any other valid and

collectible insurance available through the lessee/lessee’s representatives.

* The additional coverage cannot be implemented without prior written

confirmation that no other such insurance exists.

* The decision to add such coverage will be made on a case-by-case basis.

However, there are certain types of events that will not be covered including,

but not limited to, frat parties, rock concerts, student events produced by

someone other then the named insured, all night parties & equity productions.

* Workshops/classes sponsored by the named insured and open to the public

cannot be covered in this manner. Separate provisions exist to provide such

coverage under our theatre insurance program.

* Extension of your general liability coverage to an acceptable lessee will, under

no circumstances, provide any liquor liability insurance. If a lessee intends to

give, serve or sell alcohol, the lessee must provide proof of liquor liability

insurance prior to occupying your premises.

* If your theatre group has liquor liability coverage in their current policy,

it cannot be extended to a lessee.

* If a private individual rents your facility – a private anniversary party, for example

the individual's home owner's host liquor liability coverage may apply provided

the event does not sell or otherwise charge for the alcohol being served. It will

not be our responsibility to make this determination.

* If an individual attempts to rent your facility in his name just to try and take

advantage of his host liquor liability coverage, when in fact, he is renting

on behalf of an organization, any extension of your group's insurance will be

null and void.

This insurance option has been the number one priority of our theatre clients. It has
taken five years, so maybe it is a miracle. Whatever the explanation, you asked for it
and we are pleased to make this optional coverage available.
