NEGLIGENCE
LAW GOING FOR A CHANGE
2002-09-10 At last the Federal Government realised plans for overhaul of thenegligence laws. After collapsed of HIH the biggest
insurer and “September 11” the entire insurance industry passed
their incompetence and mismanagement on consumers by increasing premiums so
drastically that most businesses, communities and people couldn’t
afford it, putting businesses, doctors and entertaining activities
in stakes. What is the meaning of those changes? Will we as
citizens get more protection and safety net from negligent parties and
insurance companies? What will that recommendation exactly do for you?
Absolutely nothing. In a report they jump to conclusion that public did not
support any lawsuit in a “voluntary risk” and we should let off some
risk sports and communities events from negligence claim. Report saying that most people support such changes but
I don’t think so that community
support any negligence from parties, which organise any events. More changes were pushed for protecting mostly
insurance firms and businesses. People will be left out with
suffering alone to die without proper and adequate help or compensation from
someone’s negligence. There’s no such thing that the Government
protecting negligent parties giving them right to make money
knowing that safety of innocent people are in danger. They like
showing a case when a drunken person was awarded $ 4 million after he
hit his head on a sandbank. Commonsense has to be the winner in
that circle of irresponsible behaviour by some stupid,
drunken and dragged people and that we have to stop that. But legislating
people didn’t like talk about commonsense and justification for court
decision in that silly cases. Where is commonsense and responsibility of
jurisdiction system? Nobody else like judges made those stupid awards for
people who were personally responsible for their own action during
drunken rage. Does our law make illegal any criminal behaviour done by
drunken or on drugs people? Of course, that isn’t the case. I would
like to see commonsense in all parties involved with negligence claims, not only
victims. The Government wants to protect volunteers from being
sued. That is some kind of joke or the legislators’ thinks that in our
society there are people who are above the law. Where is the equality and
justice, which treat all citizens as the same part of our country? Protecting
people who are involved in any unsafe activities, which put innocent
lives at risk, is unspeakable and disgraceful. Doesn’t matter whether
someone working voluntarily or not, that person or organization
has to take responsibility and accountability too, because nobody
has rights to have indemnity for their negligent or criminal behaviour. In
such cases like that the Government has to make appropriate law, which
with commonsense won’t allow anybody to be injured or killed
by negligent parties. Any organization has to right to kill. We will see in the near future whether the Government is
a good legislator or not, when they will introduce adequate
protection for all parties in a negligence law. I hope that changes
would safe lives and give us some confidence in the law for innocent and
