WILL OF JOHN NOE

In the Name of God Amen. The 23rd day of April year 1751. I JOHN NOE of Woodbridge in the County of Middlesex and province of New Jersey, being weak in body but of good and perfect memory thanks to the Almighty God do make constitute ordain and declare This my last will and testament in manner and form following. And first being heartedly sorry for my sins past most humbly desiring forgiveness of the same I commit my soul to always by God trusting to do favor through the merits of Jesus Christ. And my body to be buried where it shall please my Executor hereafter named to appoint and as to the following of the temporal estate which it hath pleased God to bestow upon me, I order give and devise the same in manner and form following. That is to say, I will that all such debts as I truly owe shall be paid.

Item. I give grant devise and bequeath unto my eldest son PETER NOE one-third part of my plantation as it is divided of to him. It is his possession by virtue of obtaining in Deed by me given until him bearing date the 10th day of February AD 1748. To have and to hold the said lands and meadows unto him the said Peter Noe, his heirs and assigns forward.

Item. I give and bequeath unto my son ISAAC NOE the one-third of my said plantation (as by his deed dated the last day mentioned) and in the possession of the said Isaac in particularly described to have and to hold the said third part of land and meadows unto him the said Isaac Noe, his heirs and assigns forever.

Item. I give and bequeath unto my son DANIEL NOE, the remaining third which is described by a certain deed having the date the day last mentioned and in possession of him the said Daniel. Together with the mills, and stream, to have and to hold. The said third part of land and meadows, mills and stream, to him the said Daniel Noe, his heirs and assigns forever.

Item. I give devise and bequeath unto my said three sons Peter Noe, Isaac Noe and Daniel Noe all my other lands and meadows, and rights to lands and meadows in New Jersey and elsewhere in America to be equally divided amongst them share and share alike. And my will is to hereby order my said three sons: Peter, Isaac and Daniel to pay my debts equally between them.

Item. I give and bequeath unto my son JOHN NOE 40 shillings to be paid him by my Executor soon after my death which sum with what he already has is his full share and portion of my estate.

Item. I give to my son PETER NOE the sum of five pounds.

Item. I give to my daughter MARGARET ALWAYS the sum of six pounds.

Item. I give and bequeath unto my two daughters DAMARIS MARSH and MAGDALENE TOOKER each the sum of 25 pounds of which said legacy is to be paid soon after my decease.

Item. I give and bequeath unto my three sons Peter, Isaac, and Daniel and my three daughters Margaret, Damaris and Magdalene all the remainder of my estate, only my wearing apparel I give to my said three sons.

And Lastly. I do make and ordain my two sons Isaac Noe and Daniel Noe and my trust friend (unreadable) Executors of this my last will and testament set my hand raised seal the day and year first written.

Be it remembered on this 30th day of December 1751 before Thomas Barton duly authorized personally came George Brown, Daniel Mooret and Thomas J. Brown and being sworn in the holy Evangelist do design that they were present and saw Jean Noe sign and seal his will written on the other side of this sheet of paper and heard him publish, pronounce and declare the same to be his last will and testament and that at the doing he was of sound mind and memory to the best of their judgement and as they believe and that they signed their names on the testament.
