Don't Confuse the Two -- posted 10.07.02
MENTAL STATES-

***Common Law:
Specific Intent or General Intent

***Model Penal Code:
DO NOT USE Specific Intent or General Intent, DOES NOT.
Instead it uses
P.K.R.N.
Purposely, Knowingly, Recklessly, Negligently

This IS NOT AS BIG A DEAL as everyone makes it out to be. You
mention it once, and move on. ONE SENTENCE = DON'T STRESS OVER IT.

Example: "Under common law, murder is a specific intent crime. It
requires a mens rea and an actus reus. Under the MPC, murder is
either committed PURPOSELY or KNOWINGLY"

RECKLESSLY and NEGLIGENTLY are states of mind used for MANSLAUGHTER.

*****NOTE:
MPC doesn't distinguish manslaughter into voluntary or involuntary.
It breaks down manslaughter into Manslaughter and Negligent Homicide.

CL- Voluntary Manslaughter aka MPC- Manslaughter (RECKLESSLY)
CL- Involuntary Manslaughtr aka MPC- Negligent Homicide (NEGLIGENTLY)

I will go over this during Monday's review...
