States of Mind Standards Clarification -- 10.04.02
You guys know the difference between subjective and objective right?

A SUBJECTIVE standard would look at what the DEFENDANT knew or
believed during the event.

An OBJECTIVE standard would look at what the reasonable person would
have known or believed faced with the SAME situation faced by the
Defendant.

*The subjective standard is a little bit easier on the Defendant.

COMMON LAW:

Specific Intent Crimes-- Subjective
General Intent Crimes--- Subjective
Strict Liability-------- Objective

____________________________________________

MPC:

Purposely---- Subjective
Knowingly---- Subjective
Recklessly--- Subjective
Negligently-- Objective
