York District } Before me personally appeared
Sarah Brown Daughter of Robert
and Elizabeth Marsh, a resident of said District aged
___ years, and made oath in due form of law
that she always understood from her father
and mother that their first marriage was published
from the house, by a traveling Baptist Preacher,
and that they publicly
and solemly took each other for husband
and wife, from that time until the day
of her fathers, the said Robert Marsh’s death,
and acted with all due fidelity to each
other, she further says that after living
together for many years as husband and wife,
Deponents father and mother became members
of the Baptist Church and the said
Robert, intending to become a Preacher in
that denomination, they were married the second
time, that no exception might be taken
to him as a minister of the Gospel.
Sarah well recollects the last marriage,
minus the ceremony was performed by
the name of John Mills a proper
Preacher and thinks all their living children
were born at the time but Rhoda.
Deponent always understood and believed
that the above was the entire to wit her
father’s becoming a Baptist and intending to
Preach cause of their second marriage, thus
they considered their first marriage legal
and in accordance with the custom of their
tribe (the Pamunky Tribe) and which satisfied
themselves Sworn to and Subscribed this 16th day
of January 1849 before me. Sarah Brown
