SHADE-GROWN BREWED COFFEE - TITLE AND SUMMARY

The following title and summary have been prepared for
the "Organic, Fair-Trade or Shade-Grown Brewed Coffee
Initiative" submitted by Richard Young, as required by
Elections Code section 9203.

Title

Initiative Ordinance Restricting the Sale of Brewed
Coffee to Organic, Fair-Trade, or Shade-Grown
Certified Coffee. in Berkeley

Summary

This initiative ordinance would add a new chapter to
the Berkeley Municipal Code to have the following
material effects:

1. Restrict the sale of brewed coffee beverages from
business vendors in the City of Berkeley to those
brewed from coffee beans which are certified as
"organic", or "fair-trade" or "shade-grown", (terms
which are defined further in the initiative), or a
combination thereof;

2. Define "brewed coffee
beverage" as all beverages brewed from coffee beans,
but exclude ground or whole dry coffee beans;

3.
Authorize the City Manager or his/her designated
representative to enter the premises of any business
vendor that sells brewed coffee beverages for the
purposes of determining compliance with the ordinance;


4. Create a misdemeanor for a violation of the
ordinance, punishable by up to six months in jail or a
one-hundred-dollar fine, or both; and 5. Take effect
three months after adoption at an election.
