RESOLUTION
CALLING FOR AN INQUIRY, IN AID OF LEGISLATION, TO LOOK INTO THE REPORTED CONTINUING VIOLATIONS OF EXISTING LAWS AND EXECUTIVE ORDERS RELATIVE TO COMPENSATION AND ALLOWANCES OF PRESIDENTIAL COMMISSION ON GOOD GOVERNMENT (PCGG) COMMISSIONERS WHO SIT ON THE BOARD OF SEQUESTERED COMPANIES OF THE LATE STRONGMAN FERDINAND MARCOS AND HIS CRONIES AND RECEIVING EMOLUMENTS, PER DIEMS AND OTHER MONETARY INCENTIVES

WHEREAS, Section 1, Article XI of the 1987 Philippine Constitution states that public office is a public trust and that public officers and employees must, at all times, be accountable to the people, serve them with utmost responsibility, integrity, loyalty, and efficiency; act with patriotism and justice, and lead modest lives”;

WHEREAS, Section 2 of Republic Act No. 6713, also known as the Code of Conduct and Ethical Standards for Public Officials and Employees, states that “[p]Public officials and employees shall at all times be accountable to the people and shall discharge their duties with utmost responsibility, integrity, competence, and loyalty, act with patriotism and justice, lead modest lives, and uphold public interest over personal interest”;

WHEREAS, Sec. 7, paragraph (a) of RA 6713 provides that “[p]Public officials and employees shall not, directly or indirectly, have any financial or material interest in any transaction requiring the approval of their office”;

WHEREAS, Sec. 7, par. (b) of RA 6713 also states that “[p]Public officials and employees during their incumbency shall not own, control, manage or accept employment as officer, employee, consultant, counsel, broker, agent, trustee or nominee in any private enterprise regulated, supervised or licensed by their office unless expressly allowed by law”;

WHEREAS, Commissioners of the Presidential Commission on Good Government (PCGG) are reportedly receiving emoluments, per diems and other monetary incentives as members of the boards of sequestered companies of former President Ferdinand E. Marcos and his cronies;

WHEREAS, former PCGG Chairman and Senator Jovito R. Salonga, in his 2000 book entitled “Presidential Plunder: The Quest for the Marcos Ill-Gotten Wealth”, disclosed that “fiscal agents and persons appointed as directors for sequestered firms, including some PCGG Commissioners, found this secondary function more to their liking”;

WHEREAS, such holding of multiple positions by PCGG Commissioners is a clear violation of the provisions of the Constitution and RA 6713 which prohibits conflict of interest among public officials and employees as employment with the government is a public trust;

NOW, THEREFORE, BE IT RESOLVED, as it is hereby resolved by the House of Representatives, that an inquiry, in aid of legislation, be conducted to look into the reported continuing violations of existing laws and executive orders relative to compensation and allowances of Presidential Commission on Good Government (PCGG) Commissioners sitting on the board of sequestered companies of the late strongman Ferdinand Marcos and his cronies and receiving emoluments, per diems and other monetary incentives.
