The Excised Portion of Etidorhpa
http://www.geocities.com/boonehistory/julportion.html
These two documents have been reproduced on the following site:
http://www.lycaeum.org/books/books/etidorhpa/etidorhpaLloyd.html
These two documents are at the end of the entire text of Etidorhpa (which is also in the public domain — I invite you to make a copy), and it takes a fairly long time to load (so you might not have seen them anyway)!
James Duvall, M. A.
Note that in the following instance the material was supposedly removed from the rootsweb site, so I X'ed out the name of the person responsible. However my link to those documents still work, which means they are there. I have retained this to show that I posted the material first; and while I do not object to them or anyone else using it (I would have gladly granted permission as long as they were posted public domain), I wish to attach a tag to them (in case they show up again), that I shall insist that they are in the public domain, and that everyone can use them.
It has come to my notice that some of the pages on this site have been copied to other sites without acknowledgement. This is to state that the pages were transcribed and typed for Boone History, and were not copied from any other site. It is not only permitted to copy Public Domain documents for personal use, they may also be posted on the internet, as long as it is understood (e. g. if everything else on the site is in the public domain, then it may be presumed without notice that these are as well), or a notice is attached, that these documents are in the public domain. (This must be done if the copyright is claimed for everything on the site.)
This has not been done in the following case. Notice is hereby given concerning the documents taken from here and posted on XXXXXX with the following notice:
Note: Names have been omitted since this situation has since been corrected. I personally think it would have been better to clarify they are in the public domain than to yank the documents, but have it as you will.
Such a notice gives a presumption that the documents on the site are not Public Domain Documents. Despite the claim (and there are many such false claims on the internet): These documents are not under copyright. They are in the public domain, as are all public documents, and all documents on Boone History. Mere copying transcription and typing of a public document does not mean it is under copyright. (How much more true this should be if you take it off someone else's page!) Everyone is hereby given notice that these documents may be freely used by anyone with no restrictions. They must be posted as public domain documents. If they are not so posted, i.e. with a false copyright claim, then the documents must not be posted. If you find these documents anywhere on the internet you are free to use them as long as you do not attempt to restrict their use by others.
The following are documents which are at issue so far:
Boone County Deed Bk. B page 41-43
Boone County Kentucky Guardian Bonds, 1821-1829
SLAVE OWNERS IN BULLITTSBURG BAPTIST CHURCH
Slave Births from the Kirtley Bible
Sister Sealy, a Boone County Slave, tries to poison her owners, 1848
These documents were taken from www.geocities.com/boonehistory and improperly posted. The following links have been provided to document that they were taken from this site, and not the other way round. Please compare them with the above documents, and check the caches of these documents on Google.com to confirm this:
