and content] John Britten, plaintiff, against Edward Streatfeild
and his wife, Anne, Thomas Jenkin, Samuel Brewer, Robert Wanmer,
James Wanmer, William Fuller and Mary Wanmer, defendants
...Interim report, setting
out that the plaintiff had taken a mortgage of property in Rotherfeild,
18th March 1698/9, from Anne Streatfeild; that by deeds of the 21st
and 22nd Dec. 1700 she had conveyed the property to trustees, the
defendants Jenkin and Brewer to sell it, repay the mortgage and
invest the residue for her use; but the other defendants claimed
that by a family settlement of 1663, Robert, james and John Wanmer
[father of the defendant Mary] sons of Robert Wanmer and his wife
Anne [now Streatfeild] had the reversion of the property and that
the defendant Fuller had taken a mortgage of their reversion; whereupon
it was ordered that an account be taken of what was owing to the
plaintiff on his mortgage and the property be conveyed to him as
security and the mortgage of the reversion confirmed |
