Terms and conditions
1. TOUR PRICE INCLUDES
The tour price includes the use of insured motorcycle
(including CDW – Collision damage waiver) and maintenance
when touring with the group, tour guide, hotel accommodation
with breakfast and transfer from Bangkok Airport to the
beach resort and back to Bangkok hotel. Tour price includes
accommodation in twin rooms in tourist class hotels.
Accommodation commences the first day of the tour and
terminates the last. Pillion riders are assumed to be
sharing a room with their driver.
2. TOUR PRICE DOES NOT INCLUDE
The tour price does not include airfare, meals, snacks,
beverages and refreshments, gasoline and entrance fees, pre
and post tour hotel accommodation if not separately
arranged, items of a personal nature, passport and visa
fees, fines, gratuities, laundry, phone-fax calls, personal
insurance.
3. RESERVATIONS, DEPOSITS, FINAL PAYMENTS
Your tour application can be made by filling in the booking
form. Prices are quoted in pound sterling. Your spot on our
selected tour will be reserved upon receipt of your
application form plus a deposit of 50% or full payment if
you opt for price protection scheme. Payment by bank
transfer. Deposits are fully applied to your final payment
which is subject to currency fluctuation. Your booking is
considered final and binding on issuance of our letter of
confirmation.
4. PAYMENT AND DUE DATE
The balance must be paid 90 days before departure and is
subject to currency fluctuation. Organizer
reserves the right to cancel reservations not paid in full
by the due date. If you sign up less than 90 days before
departure, the initial payment must be in full.
5. CANCELLATIONS AND REFUNDS
The cancellation and refund policy is not meant to be
punitive, but your cancellation could mean cancelling the
whole tour that is based on minimum of three and maximum of
seven motorcycles. When cancellation notice is short,
organizer will have lost any possibility of replacing your
spot with another biker. We do understand that there are
unavoidable reasons for last-minute trip cancellation, so
please take out trip cancellation insurance on your own
accord to cover this situation. Organizer guarantees your
tour departure and price with sending the letter of
confirmation. We understand that once you have already
planned your holiday and flight tickets are booked it is
difficult to make changes.
• If your notice of cancellation is received more than 90
days before your a full refund less 2% will be made
• If your notice of cancellation is received less than 90
days before departure, no refund will be made because
organizer has lost any reasonable chance of replacing your
slot. Should you find a replacement a full refund less 2%
will be made
• No refund is possible for no-shows or for unused portions
of a tour.
If a tour has to be cancelled for any reason beyond AVALON
control before departure, a full refund will be paid. If a
tour is cancelled for any reason beyond AVALON control
during a tour, no refund can be granted.
6. PERSONAL INSURANCE
There is no insurance coverage for injury to the rider
and/or pillion. It is highly recommended that participants
take out additional insurance at home, at their own expense,
to cover such things as tour and travel
cancellation/interruption, personal accident, health and
medical, hospitalization, property loss etc.
7. MOTORCYCLES AND INSURANCE
The motorcycles used on this tour are governed by bylaws of
the GENERAL INSURANCE ASSOCIATION OF THAILAND. The third
party liability insurance has an unlimited ceiling. The
property damage ceiling is Thai Baht 3 million. There is no
other insurance coverage included or implied. For the
motorcycle itself, there is CDW (Collision Damage Waiver)
included. The first GBP 500 (pound sterling) of any claim is
the rider’s responsibility.
9. DRIVER & PASSENGER REQUIREMENTS
Drivers: must be at least 25 years old and hold a current
motorcycle driving license (with photo) from their country
of residence and have held it for at least one year. In
addition you will need an international driving license
endorsed for motorcycles. All local road rules must be
complied with. Your tour leader will give each rider a
briefing about local speed limits, signage, and other
applicable traffic regulations. It is rider’s responsibility
to adhere to all traffic regulations. Helmets are mandatory
and are supplied by us if you do not wish to bring along
yours..
• Passengers: Passengers must be at least 15 years old.
Helmets are mandatory.
• Drivers and passengers must be aware of traffic, road
conditions, weather and other motorcyclists.
• Drivers and passengers understand that motorcycling is a
dangerous activity and are aware of these risks, and fully
accept those risks and are solely responsible for keeping
their motorcycle under control, selecting proper speeds, and
adhering to the applicable country‘s laws.
• Drivers are solely responsible for their choice of riding
style and speed selection even when following a tour guide
in a convoy formation with other motorcyclists.
• Drivers and passengers, their heirs, successors, and
assignors agree to release, indemnify, and hold organizer,
its agents, contractors and employees harmless from any
liability or claims directly or indirectly related to
participation on a tour.
10. ACKNOWLEDGMENT OF RESPONSIBILITY – TOUR ORGANIZER
• Organizer is responsible within the framework of the duty
and care of merchant in good standing, for arranging and
providing the services listed in the tour itineraries and
descriptions.
• Organizer reviews its hotels and contractors on a
continuous basis.
• Organizer is responsible for conscientious travel
preparations.
• Organizer reserves the right to change any part of a tour
to improve its content or to adapt to changing conditions
and situations as they arise.
• Organizer is not responsible or liable for any delays or
any changes in the schedule to accommodate unplanned events.
• Organizer is not responsible or liable for any accidents
and/or bodily injury or death of drivers and passengers
resulting from the use of the motorcycle.
• Organizer is not responsible for any acts of God, strikes,
theft, or other conditions beyond our control.
• Organizer is not responsible for any loss or damage of
personal property while on tour.
11. ACKNOWLEDGMENT OF RESPONSIBILITY – DRIVERS AND
PASSENGERS
Each rider and passenger will acknowledge and accept this
Organizer’s TERMS and CONDITIONS & INDEMNITY and RELEASE
FORM at the time of reservation by returning a filled in
booking form. The participant’s signing of this CONDITIONS &
INDEMNITY and RELEASE FORM upon arrival, will be the rider’s
and passenger’s acceptance of the risks of personal injury,
property damage, or any loss associated with motorcycling.
Each rider/passenger rides at his/her own risk and is
legally liable for injury or damage to fellow participants
or other road users, whether being led by tour leader or
otherwise. Each rider must ride within his/her own skill
level and with due consideration for their own safety and
that of their fellow travellers. Each rider and passenger
must follow the directions of the tour leader. The tour
leader reserves the right to terminate a rider’s or
passenger’s tour if he considers the rider or passenger is
unsafe either to himself/herself or to others, or for
offensive behaviour, and thereby forfeiting the balance of
the tour.
12. CURRENCY FLUCTUATIONS
Tour prices are calculated based on currency exchange rates
and tariffs in effect at the time of printing or publishing
on a web site. Once you have paid a deposit for a tour, you
will be protected from any price increases and not be
required to pay any additional monies because of subsequent
currency exchange fluctuations. Prices on our web site are
valid for year 2007 only and subject to change without
notice.
13. REQUIRED PHOTOCOPIED DOCUMENTS
• Copy of: Country of residence un-expired motorcycle
driving license
• Copy of: International driving license endorsed for
motorcycles
• Copy of: Passport
The participant should bring above copies along when
commencing the tour.
14. SPECIAL ARRANGEMENTS
Persons leaving or failing to complete a tour for any reason
must make their own arrangements for transportation,
lodging, and cover the cost of motorcycle return to the
tour’s ending destination, at their own expense, unless
prior arrangements with organizer have been made. Any
cancellation refunds will consist of whatever monies can be
recovered from hotels and other contractors.
15. VERBAL ARRANGEMENTS
Verbal arrangements changing the terms and conditions
between you and organizer are only valid when confirmed in
writing by organizer. The above TERMS & CONDITIONS, in
conjunction with web site tour descriptions and features,
constitute the entire Agreement between you and organizer.
There are no other conditions, representations, guarantees,
etc, than those set herein.
16. JURISDICTION
The agreement between organizer and the Participants shall
be deemed to be made in Thailand and in case of disputes
shall be decided in accordance with the law of contract and
general law of Thailand. The parties herein agree that in
case of any dispute they will subject themselves to the
Courts of Thailand. The parties herein agree to be bound by
their decisions including all decrees and orders, interim or
otherwise and specifically recovery proceedings.
17. PHOTOGRAPHIC AND FILM RECORDS
Organizer reserves the right to take photographs or film
records of any of its trips, and to use any such photographs
and film records for promotional, sales, brochures, or other
commercial purposes.
Avalon Tours
