BETWEEN THE AMERICAN PRESIDENT AND THE BRITISH PRIME MINISTER

1. The American President is the head of the State and his government also, on the other hand, the Queen is the head of the State and, the British Prime Minister is the head of government only.

2. The office of the American President is non-parliamentary; on the other hand, the office of the British Prime Minister is Parliamentary.

3. The American President and his cabinet are not answerable and responsible to the legislature, on the other hand, the British Prime Minister and his cabinet are answerable and responsible to the legislatures.

4. The American President is all in all for choosing his own cabinet; on the other hand, the British Prime Minister chooses his cabinet on the advice of the Queen.

5. The American President is directly elected by the citizen of the United States and indirectly elected by the voting of Electoral College and represents the whole country, on the other hand, the British Prime Minister is elected from his constituency to represent his constituency and appointed by the Queen by the majority party.

6. The American President holds the office for the term of four years; on the other hand, the British Prime Minister holds the office for the term upon the backing of the House of Commons.

7. The American President may be removed through impeachment in rare cases by the two-third majority of the Senate; on the other hand, the British Prime Minister may be removed at any time for decreasing the votes of the majority party in the House of Commons and on the advice of the Queen.

8. The American President derives his power from the constitution of America; on the other hand, the British Prime Minister derives his powers from the constitutional conventions.

9. The American President cannot get all the necessary legislation enacted; on the other hand, the British Prime Minister can get the necessary legislation passed.

10. The American President is the supreme commander of armed forces; on the other hand, the British Prime Minister is not.

11. The American President enjoys all powers for appointing judges of the Supreme Court, member of his cabinet and their assistants, officer of the army, navy and air force, postmasters, customs officers, immigration officials, internal revenue collectors, attorneys, ambassadors, envoys and so on; on the other hand, there is no such power vested in the British Prime Minister.

 

BETWEEN THE JUDICIAL SYSTEM OF UNITED KINGDOM, AMERICA AND PAKISTAN


1. The highest Court of appeal in America and Pakistan shall be vested to Supreme Court. On the other hand, in United Kingdom are the House of Lords.

2. The judges are appointed in America by the President and on the advice and consent of the Senate, and in Pakistan with the consent of President; on the other hand, the judges are not appointed by the British Prime Minister on political basis.

3. The Judges are appointed in America and Pakistan for the limited term which is given by the constitutions of both the countries and can be removed from office by impeachment and with the consent of the President, on the other hand, in United Kingdom the judges are appointed for life and can be removed from office only by an address to the Crown by both Houses of Parliament.

4. Judges’ salaries are discussed by the Congress in America and by the Parliament in Pakistan; on the other hand, judges’ salaries are paid out of the Consolidates Funds, and are not discussed by the Parliament.

5. There is no jury system in judicial system of America and Pakistan; on the other hand, there is a jury system (most respectable citizens) in United Kingdom.

6. In all criminal cases the judges are all in all in America and Pakistan; on the other hand, in United Kingdom all criminal cases are assisted by a jury.

7. The lowest Civil Courts in America and Pakistan are called District Courts; on the other hand, the lowest Civil Courts in United Kingdom are called Country Courts.

8. The lowest American Court with criminal jurisdiction is known as District Courts and in Pakistan as Sessions Court; on the other hand, in Britain as the Court of Petty Sessions.

9. In America the original jurisdiction in Supreme Court is limited for cases involving ambassador, other Public Minister and Counsels or in which the state shall be a party; on the other hand, in Pakistan the original jurisdiction is not limited because all cases litigated by the inferior Courts and in England all cases litigated in Court of Petty Sessions.

10. In America and England there is no Advisory Jurisdiction like in Pakistan, the Supreme Court performs the advisory functions.

11. In America there is the Court of Military Appeals, it is an Appellate Court, and hears appeals against the decision of Court-Martial. It has no original jurisdiction; on the other hand, in Pakistan there are special Military Courts which hear appeals against the decision of Court-Martial.
