General Conditions of Supply and Payment

GENERAL - The contract shall be deemed to have been entered with the online order.
PRICES - All prices shall be deemed ex place of the supplier in freely available US Dollars without any deduction whatsoever. Any and all additional charges that could be applied in the country of destination shall be borne by the customer. The supplier reserves the right to adjust the price in the case of special supply requests of the customer. In this case, the customer needs to give a written confirmation (e-mail) to justify a price modification.
RESERVATION OF TITLE - The supplier shall remain the owner of the supply until having received the full payment in accordance with the contract.
DELIVERY TIME - The supplier normally sends the supply within a few days after having received the order. The delivery time is reasonably extended if hindrances occur which the supplier cannot prevent despite using the required care, regardless whether they occur with the supplier or a third party. Such hindrances include, but shall not be limited to, epidemics, mobilistaion, war, revolution, serious breakdown in the works, accidents, labour conflictslate or deficient delivery of sub-contractors, measures, actions or omissions by any state authorities or public bodies, natural catastrophies, acts of God. If the supply cannot be sent within 20 weekdays, the supplier informs the customer by e-mail about the delay.
PASSING OF BENEFIT AND RISK - The benefit and the risk of the supply shall pass to the customer by the date they are leaving the works.
FORWARDING, TRANSPORT AND INSURANCE - The supply normally is forwarded by air-mail. The supplier shall be notified with the initial online order of special requirements regarding forwarding and transport. In this case, the customer is informed about the additional expenses by e-mail. The customer covers all additional expenses. Objections regarding forwarding or transport shall upon receipt of the supply be immediately submitted by the customer to the last carrier. The supplier generally does not arrange any transport insurance for the supply.
SECURITY AND PROTECTION OF DATA - Credit card data are transmitted to the host in encrypted form, whereas normal e-mails are not encrypted. The supplier handles the customers' data with strict confidentiality. The supplier takes care that data are not accessible to third parties. The data are saved in a place that is physically separated from the internet. Nevertheless, absolute security cannot be guaranteed. The customer's computer and/or network are part of the system but lie outside the supplier's control and could become a weak link within the system.
EXCLUSION OF LIABILITIES OF THE SUPPLIER - All cases of breach of contract and the relevant consequences as well as all right and claims on the part of the customer, irrespective on what ground they are based,are exhaustively covered by these general conditions of supply. In particular, any claims for damages, reduction of price, termination or withdrawal from the contract are excluded. In no case whatsoever shall the customer be entitled to claim costs for direct or indirect or consequential damages. Data traffic is routed via a public network, the internet, and the supplier disclaims any liability for damages resulting from the use of the internet. In particular, the supplier cannot be held liable for damages the customer may suffer as a result of transmisson errors, technical faults, malfunctions, illegal intervention in network equipment, network overloads, malicious blocking of access by third parties, internet malfunctions, interruptions or other deficiencies on the part of the network providers.
PARTIAL INVALIDITY - The invalidity, unlawfullness, or inability to enact one or more of these regulations does not affect the other parts of the agreement.
JURISDICTION AND APPLICABLE LAW - The place of jurisdiction for both the customer and the supplier shall be at the supplier's domicile. The supplier shall, however, be entitled to sue the customer at the latter's domicile. The legal relationship between the customer and the supplier shall be governed by the law at the supplier's domicile.
