Feb
4, 2004 - Disaster Damage - A
serious water flooding to the above suite causing tremendous damage to the
carpets, wall-covering, faucets, living room, bedrooms and personal property
including furniture, clothing, shoes, books, household tools, …..
The suite was unsanitary and unsafe to live, we moved out
for immediately repairs, we were not able to use the above rental unit during
repair damage working here.
Feb 4, 2004 to Feb 6, 2004 – Moving and storing personal
property out of the above suite, and removing debris, to enable access to the
repair workers. (Tenant’s Working
hours: 3 persons X 40 = 120 hours)
Feb 14, 2004 - the
suite was in excessive humidity, the foot of all walls were holes with 2-3
inches in between, the carpet after cleaning put back in living room was still
wet, the carpet after cleaning in the master bedroom was fully wet,
the heaters in the master bedroom were lying on
the floor instead of on the wall, one
bedroom was no carpet , bathrooms and kitchen were full of stuffs,
all wardrobes were no doors, windows are opened all the time to reduce
the water vapour. It was not
healthy and sanitary for stay or live.
Feb 14, 2004 to Feb 23, 2004 - Conditions
were the same as Feb 14, 2004, only the humidity was better. It was still not healthy and sanitary for living.
Feb 24, 2004 to Feb 25, 2004 - worked on filling wall holes, all stuffs in the suite were
placed in the centre to enable working. (Tenant’s
Working Hours: 3 persons X 4 = 12
hours)
Feb 28, 2004 Conditions
were the same as Feb 24-25, the
wardrobe doors were put back.
March 5, 2004 - An
inspector came and inspected the process of repairs, and told us that repairs
would continue on March 9-10, and 12. A
new carpet will be put to replace the damaged carpet in the master bedroom and
the hallway between master bedroom and bathroom.
March 7, 2004 – We still had our personal property storing out of the suite, it was still not a health, sanitary and standard home for a living being to be rented.
If the repairs complete on or before March 15, 2004, we
will need a week (March 16-22) to allow the hazardous smell of
paint to emit before we can restore our personal property back to the
suite.
We suppose that we may reuse the above suite on or after
March 23-24, and will need 30 hours (3 persons x 10 hours) to complete
restoration of our personal property back to the suite.
(Tenant’s Working hours: 30 hours).
During the occurrence of the disaster damage to the above
suite, we put our best efforts to co-operate to everything for renovation of
your suite.
Besides the loss of wages due to absent from work in order
to settle the disaster situation; loss of personal effects,
extra cost and work for cleaning and drying for clothing, furniture,
home appliances and home wares; and extra expenses for living, travelling, and
eating during the renovation in your suite.
You should compensate us the labour cost incurred in the
removal, storage, and restoring of the personal property, and the removal of
debris.
As Feb-March 2004, the above suite was an unhealthy,
unsanitary, and not a standard place to live and be rented.
We are not entitle to pay the February and March Rent.
Because of our good relationship, we decide that you only
need to compensate us for one month rent ,
as we had paid the said monthly rent, therefore we need not to pay rent
for the month of April 2004.
