Ordered by the Court that Allen Couch be and he is Appointed Guardeon [sic] for Benjamin Fugate, Rebecca Fugate, William Fugate, Jefferson Fugate, Andrew Fugate, Sally Fugate, and Elizabeth Fugate, and thereupon the Oath was administered to him and thereupon he entered in to an acknowledged Bond to the Commonwealth of Kentucky according to Law.

On this 12th day of July 1870 before me the Clerk of the Owsley County Court personly [sic] appeared John B. Campbell whom I Certify to be respectiable [sic] and entitled to be believed and after being duly sworn states on oath that he was 1st Lieutenant in Co. C. Three Forks Batallion[sic] Kentucky State Troops, and further states that Martin Fugate a sergeant in said Company Was killed in a Battle with the Enemy, or the Rebell [sic] forces, in Perry County on the 3d day of January 1865 whilst under my Command as a Lieutenant in said Company + Batalion [sic] and fighting in defence [sic] of the Government of the United States that said Martin Fugate and the Command to which he belonged was sworn into the United States service as Kentucky States troops to obey all commands of there [sic] superior officers + the United States army and states that he has no interest direct or indirect in this Claim.

On this 25th day of October 1870 before me the Clerk of the Perry County Court personly [sic] appeared John B. Campbell whom I Certify to be respectiable [sic] and entitled to be believed and after being duly sworn by me states on oath that he was 1st Lieutenant in Co. C, of the Three Forks Batallion[sic] Kentucky State Troops, and states that service for the purpose of assisting in suppressing the Rebellion of 1861 +c and also sworn to obey all legal orders and Commands of the Officers in the United States Service and that said Co. C did assist in putting down the said Rebellion and States that he was in command of said Company and Commanding a detachment of said Co. of 20 men on a scout in Perry County Ky at the time Martin Fugate a sargeant [sic] of said Co. C, was killed which was on the 3d day of January 1865. Said Martin Fugate belonged to said Detachment at the time he was killed and was engaged in a fight with about 60 of the Rebel forces under the Command of Captain Anderson Hays and in said engagement the Rebells [sic] killed the said Martin Fugate, William Milom and wounded Thomas Howskins all of said Co. C and under my Command. Said Martin Fugate belonged to the service above mentioned and was constant on duty from August 1864 to January 1865 and was in Line of duty and under my Command at the time he was killed and states that he has no interest direct or indirect in the prosecution of this Claim.

On this 25th day of October 1870 before me the Clerk of the County Court for the County aforesaid personly [sic] appeared Thomas Houskins who I certify to be credible and entitled to be believed and after being duly sworn States that he was a member and belonged to Co. C , of the Three Forks Batallion [sic] Ky State Troops and was sworn in to said service to assist and obey the Officers of the United States service to assist in putting down the Rebellion and states that about the 3d day of January 1865 that about 20 men of said company C. was ordered on a scout in Perry County under the Command of Lieut. John B. Campbell and whilst on said scout they were attact by about 60 men of the Enemy or Rebells [sic] under the command of Captain Anderson Hays of the Rebel army and in said engagement with said Rebell [sic] forces that Martin Fugate a sargent [sic] in Co. C, was kill[ed] by said Enemy by being shot dead also William Milom was killed and this affiant was wounded by a gunshot in said engagement and whilst in line of Dury and further states that said Martin Fugate was engaged in said Co. C from August 1864 to January 1865 in assisting to suppress the Rebellion against the United States and states that he has no interest direct or indirect in this Claim.

On this 27th day of December 1870 before me the ___ ___ Clerk of the Owsley County Court personally appeared G. W. Daniels whom I Certify to be respectable and entitled to belief and after being duly Sworn by me States that on the 17th day of August 1864 he the said G. W. Daniels having before said time being appointed Mustering Officer By the Governor of Kentucky to muster Kentucky State troops into the Service to assist in putting down the Rebellion and being ordered by the Governor to muster in to said service various Companies and on the said 17th day of August 1864 he mustered into said Service Co. C, of the Three Forks Batalion [sic] Ky State Troops and that John B. Campbell was mustered in as 1st Lieutenant in said Company and that said Company was mustered into said service and sworn in to obey there [sic] Superior Officers of the United States in assisting in putting down the Rebellion and that said Company drew Clothing, Arms and Ammunitions of war the same as soldiers of the United States Service and further states that said Company was ordered into active service by the Adjutant General of Kentucky and did actualy [sic] rencer service in putting down the Rebellion by having several engagements with the Rebell [sic] forces and Capturing several [?] of the Rebell [sic] soldiers and sending them off to the Prisons and that said John B. Campbell was in command of said Company about the 3d day of January 1865 and that Martin Fugate was a soldier in said Company and was killed in an engagement with the Rebell [sic] forces in Perry County about the 3d of January 1865 and states that said Company was mustered out of said service at Irvine Ky by Orders of the Governer [sic] on the 17th day of July 1865 and was discharged from said service accordin [sic] to the rules and Regulations of the United States Soldiers and was under said rules and Regulations whilst in said Service and further states that he has no interest direct or indirect in the prosecution of this Claim.

On this 31st day of December 1870 before me the undersigned [?] Clerk of the Owsley County Court personly [sic] appeared Major E. B. Treadway and after being duly sworn states that he was Major Commanding the Three Forks batalion [sic] Ky State Troops and that said Troops were ordered to be recruited and mustered into the service by the Governor of Kentucky to assist in suppressing the Rebellion and the said troops was mustered and sworn in to the service to act with the United States troops in putting down the Rebellion and that said Batallion [sic] did render valuable service in putting down the Rebellion by Contending in skirmishing with the Rebell [sic] army and capturing and sending off several Rebell [sic] soldiers, and that John B. Campbell was a Lieutenant in Co. C of said Batalion [sic] and that said Co. C. was engaged in several skirmishes with the Rebell [sic] forces and Lost several men killed _____ _____ _____ and that Martin Fugate as Sargent [sic] in said Company was killed by the Rebell [sic] forces in Perry County on the 3d day of January 1865 and at the same time and place William Milom a private in said Comp. was killed and Thomas Houskins a private in said Company was wounded by the Regular Rebell forces and that said Company + Batalion was Mustered out of said Service at Irvine Ky on the 17th day of July 1865 by Orders of the Governor of Kentucky said troops was sworn in to the service to obey there [sic] superior Officers in the state or United States Service according to the rules and regulations of the United States Service and further states that he has no interest direct or indirect in the prosecution of this Claim.

On the date hereinafter mentioned personally apeared before me..a county court clerk...the same being a Court of Record within and for the County and State aforesaid, ..Susan Couch...aged 56 years, who being duly sworn according to law, makes the following declaration in order to obtain the pension provided by Act of Congress granting pensions to widows: That she is the widow of..Martin Fugate...who enlisted..under the name of..Martin Fugate.. at Booneville, Ky..on the..17th..day of..August..A.D. 1864 in..Co. C. 3d Batty. Ky Vols....in the war of..1861..who..was killed in action...on the 3d..day of ..January.., A.D. 1865, who bore at the time the disability was incurred which caused his death, the rank of.... in said organization.; that she was married under the name of Susan Hoskins.., to said..Martin Fugate..on the..11th ..day of ..September.., A.D. 1851, by Daniel Duff at Wm. Hoskins..there being no legal barrier to such marriage; that neither she nor her husband had been previously married ...that she has remarried ..to Allen Couch Nov. 23, 1865..; that the following are the names and dates of birth of all the said soldier's legitimate children yet surviving who were under sixteen years of age at his death, to wit:

that she hereby authorizes and empowers Milo B. Stevens & Co. Cleveland, Ohio with power of substitution, to prosecute her claim; that her residence is..Hazard, Perry Co. Ky...and that her postoffice address is..the same..
