Benjamin and Sarah had another child, Lydia Margaret Cofer. She was the wife of Levi Marshall and lived next door on the 1850 census.

You are hereby commanded to take the body of Benjamin Cofer if to be found in your County and him safely keep so that you have him before the Judge of the Superior Court of Law and Equity to be held for the County of Stokes at the Couty seat in Danbury on the third Monday after the fourth Monday in September next, or till he shall give you good and sufficient security in the sum of three thousand dollars to appear and answer at the said Court on on the day aforesaid to a bill in Equity filed in the office of the clerk & master in Equity for the county of Stokes against him by Levi W. Marshall & wife Lydia M., James B. Cofer, Lewis T. Cofer, William Cofer, James Lawson & wife Eliza Ann of full age and Jesse W. Cofer, Benjamin F. Cofer, D. J. Cofer, John Cofer, Samuel Cofer and M. Lafayette Cofer infant who sue by their [?] friend Levi W. Marshall and their [?] shall in name Omit at your [?].

Why did Benjamin's kids sue him? One theory is that he freed several slaves (Eliza, Joe and Margaret) he had received in 1859 from his brother Jesse Cofer (likely serving as executor of their father's will--James Cofer d. 1857). In 1860 Benjamin is living with his family but does not appear on the slave schedules as a slave owner.
