AUTHOR: Alison (AKA Alleyb) TITLE: Trusting Again SYNOPSIS: Set after the season 3 finale, Bobby represents a guy accused of breaking into a woman's house and stabbing her in her bed (she doesn't die). Lindsay finds it hard to deal with and jeopardises the case. (night. Bobby's apartment) Lindsay: Why did you take this case after what happened to me? How could you represent a bastard like him? Bobby: We never turn down a client you know that. We can't let personal issues get in the way of this man's defence Lindsay: Bobby, we have turned down cases. What about Ellenor's asbestos client? You had no problem turning them away. Bobby: I wasn't the only one who turned him away. If I remember correctly, you protested quite strongly about that. I know this is hard for you, but he's just a man accused of a crime. Don't worry. Lindsay: I don't even want to be in the same room as him. Bobby: How about settling for being in the same room as me? Lindsay: (smiling) I guess I can handle that! (they kiss, both dropping the files they are holding) Cut to morning, the day of the trial Ellenor: (smirking) where's Bobby and Lindsay? Rebecca: Oh leave them alone, why do you always have to find something in their relationship to gossip about? Lucy: I like gossip Rebecca: We know Ellenor: come on Bec they're the only ones in this office with a sex life Jimmy: Hey, you know nothing about my personal life. I don't like you making judgements Ellenor Ellenor: What, you mean the judge? That wasn't sex Jimmy, that was her pleasing herself. Like she does with every other man she can find. Jimmy: Like I said you don't know anything. Eugene: (To Ellenor) What's gotten into you this morning anyway? Ellenor: Nothing, I'm just saying- (Bobby and Lindsay walk in, looking tired) Bobby: (to Eugene) you all set? Eugene: yep. Vince called. He'll meet us there Bobby: Right, lets go then. I'll just get my briefcase. (he goes into his office, Lindsay follows) Lindsay: Don't bring him back here Bobby, I don't want to see him Bobby: Do you think I'd do that? I'm here for you, you know that right? (he leans forward to kiss her. Ellenor walks in) Ellenor: Didn't you guys get enough last night? Bobby, Eugene's ready to go. Bobby: Alright! I'm going. (Ellenor walks out) (to Lindsay) I'll see you tonight. cut to courtroom, victim (michelle) being questioned Bobby: Ma'am I'm very sorry for what happened to you, but how could you be so sure it was this man who stabbed you? Michelle: They caught him outside my apartment Bobby: so you didn't see the man when he attacked you Michelle: No, but it had to be him Bobby: can you explain how you were attacked? Michelle: Well, I heard a noise and went into the kitchen to get a knife. Before I reached there, I felt somebody grab me from behind and then they (sniff) stabbed me in the back. They then left. I had my cell phone near by and I called the police. Bobby: So you didn't see his face, his body shape, height, hear his voice? Michelle: No! He just stabbed me Bobby: then how can you be sure the right man is on trial here? (lindsay walks into the back of the court) Michelle: (in tears) It MUST have been him! Bobby: no further questions Back to courtroom. Defendant (Vince West on the stand) Bobby: I have to ask you Mr. West, what were you doing outside the apartment block so late? Vince: I had just visited ..uh.. a friend and was about to go to my car. The police just pulled up and began yelling at me. They arrested me without telling me why. Bobby: who was this friend? Vince: I can't say Bobby: your on a serious charge here, can't this person verify that you were with him? Vince: NO. Look, he'll kill me if I say his name. Bobby: You'd rather go to jail? Vince: No, I didn't do it! I shouldn't have to go to jail for something I didn't do. I've never seen that woman before in my life! Bobby sits down, DA Richard Flood gets up Dicky: That's a nice little story you've got going there Vince: Its not a story Dicky: So you have no idea who this woman is? Vince: No, I've never seen her before Dicky: Maybe because you stabbed her from behind? Bobby: Objection Judge: Sustained Dicky: You were wearing gloves and a dark hat the night you were arrested, weren't you sir? Vince: Yes, it's winter Dicky: That's pretty convenient don't you think? Was it to prevent leaving fingerprints? Vince: No it was cold Dicky: for how long were you standing outside? Vince: Maybe 10 minutes. I was having a cigarette. My girlfriend doesn't like me to smoke in the car Dicky: You were lighting a cigarette? Vince: yes Dicky: sure (sarcastic) Bobby: Objection Dicky: withdrawn. No more questions Cut to Bobby's office Lindsay: How could you make her cry? She didn't do anything wrong. Would you have made me cry if I were on the stand? Bobby: I didn't MAKE her cry, I was nice Lindsay: You should have been nicer Bobby: That's not me. I don't want to be nice in court Lindsay: Then maybe you should try. You might win more cases. Bobby: So I'm not winning enough now? You want me to work harder? Lindsay: That's not what I'm saying Bobby: what is this. We get engaged and you try to take over my life? Lindsay: (smiling for the first time) You got it! The victim (Michelle) is sitting in the corridor of the courthouse crying. Lindsay walks past and recognises her. She sits down and offers her a tissue Michelle: Thanks Lindsay: No problem. I recognise you from the news. I'm really sorry about what happened Michelle: your not a reporter are you? Lindsay: No, a lawyer Michelle: (smiling) even worse. (she looks closely at Lindsay) Do I know you? Lindsay: Maybe. Some guy stabbed me a month ago. (grimacing) It was well publicised Michelle: did they catch him? Lindsay: Maybe. They went to question the main suspect and he pulled a gun on them. They shot him before he could be questioned. Michelle: God, I'm sorry. At least I know that I'm putting this guy away for a long time Lindsay: I hope you've got the right guy! (Richard Flood walks by as she says this) Dicky: Lindsay, what the hell are you doing!? Did you think you could get away with this? (cut to judges chambers) Dicky: Your honor, she is from the defendants law firm. This is a firm that has tried anything and everything in the past to get a client off. They should all be reported to the bar for this. And there should be an automatic ruling against the defendant. Judge: I'm not going to go that far counsel. I may report them to the bar, but I want to speak to everyone involved first. (to Bobby and Eugene) and I hope for your sake, you had nothing to do with this. Later...Bobby's office Bobby: What the hell do you think you were doing Lindsay? You are from our firm and you were seen talking to the victim. How do you think that looks! Lindsay: She was crying. I was just trying to comfort her Bobby: I don't care if she was about to have a heart attack! You don't approach her. And you weren't comforting her. You were heard asking whether she had the right guy. That's our whole defense! Of course they're going to scream about obstruction of justice, they have every right to. Lindsay: I'm sorry, ok? Bobby: (sighing) Stay away from this Lindsay. Don't let it get to you. Just stay away. Lets see if we can get out of this mess. (Judges Chambers) Michelle: we were just comparing experiences that's all Judge: So she made no comments as to the validity of your accusations and testimony? Michelle: Well, she asked whether I was sure I had the right guy, but that was just concern Judge: You had no idea she was from the defendant's lawyers' firm? Michelle: No (Michelle leaves, Lindsay enters) Judge: Do you realise that you could be suspended for this? Lindsay: Yes Judge: Ms Dole, consider yourself lucky that I feel sorry for what happened to you a month ago. But listen carefully. If I so much as see you near the courtroom before this trial has finished, I will report you. I don't like it when lawyers try to get away with tampering with witnesses. Consider yourself warned. I'll be keeping a close watch on you. Lindsay: Yes your honor Bobby's apartment, Lindsay lets herself in to find Bobby in his/their room Bobby: well? Lindsay: nothing. He's letting the case continue Bobby: Lindsay, I don't need to tell you that you were in the wrong here Lindsay: Bobby, don't lecture me. I'm going to bed Bobby sighs and watches her leave the room Next morning, courtroom Judge: has the jury reached a verdict? Foreman: we have your honor Judge: what say you? Foreman: In the matter of commonwealth versus West for the charge of aggravated assault, we find the defendant...........not guilty. Judge: the jury has reached a verdict and is free to go with the court's thanks...(fade out) In the office Ellenor: Well? Lucy: not guilty! Rebecca: has anyone told Lindsay? Lindsay: Has anyone told me what? Ellenor: Not guilty Lindsay: oh Door opens, it is Michelle she hesitantly walks in Michelle: Hi, can I speak to you for a moment? Lindsay: Uh....well I'm not supposed....sure (others frown) Lindsay: I'm sorry about the verdict Michelle: yeah well, who says life is supposed to be easy? I have to go, but I just wanted to come by to thank you and to give you my card...if you ever want to talk, call me. Lindsay: that would be great Michelle: and thank you, really Lindsay: All I did was get us into trouble! Michelle: But you're the only one who understands. So thanks. Lindsay: no problem. Bobby's bedroom... Bobby: I don't think we should do cases like that any more Lindsay: You mean you've been listening to what I've been saying? Bobby: Sweetheart, I always listen to you. Lindsay: Good, that's the way it should be Bobby: I'm sorry I got angry. It just seemed like a stupid thing to do. Lindsay: I had to Bobby. Ever since that guy stabbed me, I have felt so alone. I felt like she was my only hope Bobby: I have always been here for you Lindsay: I know, and I love you, but she really understands. (smiling) you help me in other ways. Bobby: Like this? (leaning forwards to kiss her) Lindsay: Maybe the lights fade out as they kiss Cut to Jimmy and Kittleson in her chambers Kittleson:So they don't know we're back together? Jimmy: are you kidding me? They'd kill me for it! Kittleson: I hear Bobby and Lindsay are engaged. (she looks away) Jimmy: yeah. (Pause) What's wrong? Kittleson: Oh...nothing. (looking wistful) THE END!
