Scene: The office.
Jimmy: Can you draft up a motion to compel on Peters?
Lucy: Documents?
Jimmy: Yeah.
(Bobby walks in, looking at a file.)
Lindsay: Bobby, you ready?
Bobby: Ready?
Lindsay: To go to the printers for the invitations?
Bobby: Oh God, I completely forgot! I got the Strauss depo at 10. (to
Jimmy and Ellenor) Discovery's over on Peters?
Jimmy: But we still don't have the medicals.
Lindsay: You promised!
Ellenor: Strauss, that jerk?
Bobby: That client. (to Lindsay) I'm sorry. (to Jimmy and Ellenor) You
should move for sanctions.
Jimmy: I'll never get that...
Lindsay: You scheduled this depo intentionally.
Bobby: (to Lindsay) I didn't! (to Jimmy and Ellenor) At least try.
Lindsay: Can you at least look? (holds up prints for the invitations)
(Bobby sighs and looks) Parchment with black ink or white with embossing?
Lucy: Yes on sanctioning, Bobby?
Bobby: (to Lucy) Uh... yes.
Jimmy: The embossing is nice.
Lindsay: (not meanly) I didn't ask you.
(Lindsay looks expectantly at Bobby)
Lucy: Bobby, you're going to be late. Here's Strauss' address. (hands a
paper to him)
Lindsay: Bobby!
Bobby: Uh... white with the gold border.
Lindsay: That wasn't one of the choices!
Bobby: You asked my opinion.
Lucy: (quietly) Doesn't mean she wanted it...
Bobby: White with the gold. (walks out)
Lindsay: He didn't even look.
Jimmy: They never give you sanctions. (to Ellenor) You ever get sanctions?
---------------------------------
(Bobby is in a parking garage walking to his car. He presses the remote
button and the car beeps twice as he approaches. A man comes up from
behind and pushes him onto the car. Bobby tries to get free. The guy slams
his head against the hood of the car, leaving blood on the car and on
Bobby's head.)
Bobby: (weakly, his head against the car) Here's the keys.
Guy: That ain't gonna do it.
Bobby: Here's my wallet...
Guy: That ain't gonna do it, either. (Bobby makes one last attempt to get
the guy off, but the guy slams him back onto the car and punches him in
the stomach) (Pulls out a gun) Maybe you didn't see the gun, huh? (shoves
it into Bobby's face)
Bobby: Take my watch... ATM card... whatever-- whatever you want.
Guy: I want you, Bobby Donnell. I came for you.
(Opening credits. They pick the best times for commercials in this one.)
------------------------------------------
(The guy and Bobby walk into a house. The guy is pushing Bobby ahead.)
Guy: Over there! (He shoves him into the house. Bobby falls on the floor,
but quickly gets up)
Bobby: (raising his hands) Look pal, I don't know what you want...
Guy: Sit down. (Bobby is hesitant) Sit your ass down! (He pushes Bobby
into a chair) Do me a favor too, okay? (Leans close to Bobby's face, Bobby
is breathing hard) Don't call me pal. I want you to call me Mr. Rooney.
Okay? Ain't that what the judge called me, huh? Mr. Rooney? Right before
he dumped my ass in the hole for 12 years? (He walks up to Bobby with a
rope and starts tying his hands up behind the chair)
Bobby: Rooney?
Rooney: Yeah. Rooney. Patrick Rooney. Your old client.
Bobby: When?
Rooney: 1988. Braintree. Double homicide. (he finishes tying his hands up)
I didn't think you'd remember. (Walks to a different part of the house)
Bobby: Wait a second. Rooney. I got you a deal, didn't I?
Rooney: (Walking back) Yeah. You got rid of me. That's what you did.
Bobby: What are you talking about?
Rooney: Shut up! (waves the gun at him)
Bobby: (shaking his head) Wait a minute. Wait a minute. Rooney. You had a
trial!
Rooney: (He now has a bigger, riffle-y sort of gun) Some trial. You were
really good there, too. (Sits across from Bobby with the huge gun)
Bobby: You sat there. You heard the evidence. You said yourself the jury
was going to convict. I didn't force you to take any deal. What are you
talking about?!
Rooney: (yelling and pointing) You told me it was this or life! (Bobby
looks shocked and confused) So I did 12 years for killings that I didn't
do. (He opens up the giant gun and puts a giant bullet in it. Bobby
watches him, scared) It's judgment day, Bob. Now you're on trial.
---------------------------
Scene: An invitation store.
(Lindsay is walking looking at the order form)
Lindsay: I really hope I ordered enough invitations.
Helen: 250. Lindsay, it's a wedding, not a Celtic game.
Store owner: I really don't think you should rush her.
Helen: Excuse me?
Owner: If you're not here to be helpful...
Helen: (sitting down next to Lindsay) Y'know, maybe you should pretend
like you have another customer.
Owner: Aren't you the witch? How many came to your wedding?
Helen: I'm not married.
Owner: Big surprise.
-------------------------
Scene: Back at the office. Everyone but Bobby and Lindsay are there.
Lucy: (hanging up the phone) That's weird. Hey, has anyone seen Bobby? He
hasn't shown up yet for the deposition.
Ellenor: Well, maybe he got caught in traffic.
Eugene: He left over an hour ago and he was only going to Medford. (They
all look at each other)
-----------------------------------
Scene: The hostage house.
(Patrick is looking out the window)
Bobby: You want to tell me what your problem is or what?
Patrick: You're my problem!
Bobby: That much I gather. Maybe you could be more specific.
Patrick: (turns around) Y'know, it would be poor judgment for you to get
smug right now.
Bobby: All right, look, I'm sorry if you felt you didn't get a fair shake.
It happens sometimes. It's not a perfect system.
Patrick: Well, I got news for you. It wasn't the system. It was you.
Bobby: You may want to think that, but-
Patrick: Hey, I just wanted to take the stand and tell my side of the
story. But you- you wouldn't let me.
Bobby: I did that to protect you-
Patrick: To protect me?
Bobby: Yes. You had a list of priors.
Patrick: Doesn't mean I killed anyone.
Bobby: You take the stand, the priors come in.
Patrick: I wasn't on trial for my priors!
Bobby: That wouldn't have mattered to the jury. They just would've
concluded that--
Patrick: The jury should've heard me say that I didn't kill anybody!
Instead, I sat there with my mouth shut on your advice, and they made
their own conclusions, didn't they, counsel? (pulls up a chair across from
Bobby) You know what really bothers me? You know what's really been eating
at me? You. You never even asked to hear my side of the story. You didn't
even want to listen.
Bobby: There's a reason for that. Whatever you tell me as a client, I'm
stuck with it. If I know you're about to lie on the stand, I have a duty
to go to the judge and tell him. It's better in some situations for the
lawyer not to hear what happened!
Patrick: Assuming that I would be lying. Which I wasn't. I was gonna tell
the truth. But you refused to believe me!
Bobby: (softly) Okay, Patrick. Okay. Tell me the story.
(Patrick swallows and begins his story.)
Patrick: I stayed in the car that night.
(Flashback to the night of the murder, they show a man getting out of
Patrick's car)
Patrick (V.O.): Mickey went inside. I had no idea what he was going to do.
(shows Patrick in the car, twiddling his thumbs.) I only drove him to his
ex's because he said he had some things to get back from her. He told me
he was going to talk to her. It'd just take a few minutes, so I waited.
All of a sudden I heard shots going off. (shows a window and lights
flashing, and you can hear gunshots) I didn't even know Mickey had a piece
on him that night.
Bobby: But you ran-
Patrick: I freaked! (Flashback again. Shows Mickey running out of the
house with a bag over his shoulder.)
Patrick (V.O): I turned around, I seen Mickey come out covered in blood.
(shows Mickey standing in the middle of the street while Patrick dries
away) I couldn't have any part of that, so I took off, okay? (End
flashback)
Bobby: Even if that were true, we had no way of proving it. Mickey didn't
live long enough to back you.
Patrick: Because the police killed him!
Bobby: As I recall, they found your jacket next to the bodies with the
mother's blood all over it-
Patrick: (standing, yelling) Mickey borrowed my coat!! I'm telling you, I
stayed in the car!
Bobby: Okay, Patrick, I believe you. I believe you.
(Patrick gets mad and hits Bobby in the stomach with the gun, really hard.
Bobby kind of grunts bends over in pain.)
Patrick: Don't play with me. You never believed me!
(Bobby's cell phone rings. He's still in the same position. Patrick
reaches in is suit pocket and pulls it out, pressing the talk button.
Rebecca's voice comes over.)
Rebecca's voice: Bobby? Bobby, are you there? Bobby?
(Patrick puts the phone on the chair and slams the gun down hard, right in
the middle of it, breaking it into millions of pieces and, of course,
cutting off Rebecca.)
(cut to the office, Rebecca on the phone)
Rebecca (into phone): Bobby? Bobby.
(Eugene walks over) (Rebecca kind of looks at the phone, a confused and
concerned look on her face)
Eugene: What?
Rebecca: I think he answered, but then it went dead.
Eugene: Well, it probably didn't go through.
Rebecca: No, no. Somebody answered. (Eugene looks thoughtful)
-----------------------------------------
Scene: Back at the invitations store.
Owner: All right. (hands Lindsay a paper)
Lindsay: This is wrong. It's not "Mr. and Mrs. Robert Donnell". It's
supposed to read "Ms. Lindsay Dole and Mr. Robert Donnell" on the
envelopes.
(the owner nods and writes something down, adding a thoughtful "hmm")
Lindsay: What?
Owner: You're sublimating.
Lindsay: I'm what?
Owner: You're taking it out on the envelopes, it's very common. Things
will go a lot smoother with your second marriage. I heat my pool on repeat
business.
Helen: People actually come back to you?
Owner: You're hurtful. And you wonder why you can't latch onto a husband.
(Stands and walks away, the evil look on her face pointing at Helen.)
(Lindsay and Helen stare at each other as a cell phone rings.)
Helen: Is that you or me?
Lindsay: I got it.
Owner: (walking away) Drug dealers.
(Lindsay picks up the phone)
Lindsay: Yeah? Ugh, no I haven't heard from him..... Did you try his cell
phone? ..... That's strange. (she says this with fear developing in her
throat) Okay, I'm on my way. (hangs it up and stands)
Helen: What is it?
Lindsay: Bobby never showed up for his deposition, and no one's heard from
him. (Helen stands too and follows her out the door)
-------------------------------
Scene: Hostage house.
(Patrick's got a gun attached to a thing around Bobby's neck. He is
leading him into a chair)
Patrick: You're breathing pretty heavy, counsel. What's the matter, you
scared?
Bobby: (sitting) Isn't that what you want?
Patrick: I'd just hate to see this gun go off by accident. That would be
ironic, wouldn't it? See, I'm having a hard time living with your mistake,
and you certainly couldn't live with mine.
Bobby: Patrick, however angry you are, you're free now. You're out. Why
throw that all away?
Patrick: Hey. It was all thrown away the day you were assigned to me.
Bobby: Fine. So now what, you're gonna kill me and go back to prison? Your
life will be over.
Patrick: (raises voice) Let me tell you something, Bobby. The only thing
that's kept me going is hate. Knowing that if I just stuck it out, I would
get the chance to have this very moment right here. That's the only thing
I've had to cling to for the past 12 years. Now that might not seem like
much to most people. But for me? To have the chance to kill you...
Bobby: If that were it, you would have done it.
Patrick: Oh, it'll happen. But first, you're gonna face the facts. The
facts that could've cleared me. The facts that you ignored. And then I'll
kill you.
(Commercial. See, I told you.)
-----------------------------------
Scene: The office.
(All except Eugene (and obviously Bobby and Lindsay) are on the phone, all
talking at once.)
Jimmy: Nobody at all? Maybe he came in with a head injury. An amnesia
thing. He could've come in as a John Doe. No?
Ellenor: He's about 6'1", dark brown hair, blue eyes. Yes, Donnell is the
last name. Yeah, sure, I'll hold again.
Rebecca: (off phone) Nothing from Mass General.
Ellenor: Ditto from Tufts New England.
Eugene: And they're still saying his cell phone is out of range and not
turned on.
(Lindsay runs through the door with Helen close behind)
Lindsay: Any news?
Jimmy: Nothing. He hasn't shown up at a hospital.
Helen: Did you call the police?
Jimmy: Not yet.
Lindsay: Why not?
Rebecca: Lindsay, I'm on it.
Helen: Get Maguire. I'll talk to him.
(Rebecca nods and dials the number.)
Lucy: Lindsay, I'm on the phone with Bobby's credit card company. They're
saying something about him buying electronics equipment. DVD player, wide
screen TV..
(Lindsay takes the phone)
Lindsay: Hello, this is Lindsay Dole I'm Mr. Donnell's fiancee. Is the
person using Mr. Donnell's credit card still at the electronics store?
Then get them to hold him. What do you mean, you can't?! He's got his
card!
(Helen grabs the phone from Lindsay)
Helen: Look, this is Helen Gamble of the Suffolk County District
Attorney's office. I need you to talk to your manager. Tell him to have
security hold the man until the police-- I don't care what your policy is!
Do what I say or I will charge you with obstruction of justice. (to Lucy)
Give me the number of the store. (Lucy hands it to her. Helen starts
writing something down.)
--------------------------------
Scene: Hostage house.
Patrick: Y'know, I can still remember the first time you came to see me in
the lockup. You walked in real sharp. I figured "Great. Some big Harvard
type attorney. No problem." Did you go to Harvard, Bobby? (Bobby is
silent) Hey. I asked you a question.
Bobby: I went to Suffolk.
Patrick: Suffolk? That's a race track.
Bobby: Look, what the hell do you want from me? I've been sitting here for
three hours--
(Patrick stands up and points the gun straight at Bobby.)
Patrick: You son of a bitch! I'd kill you right now if I wasn't...
Bobby: What? If you weren't what?
Patrick: You just shut up. You just shut your face and sit there!
--------------------------------------
Scene: Some interrogation room thing. Mike is questioning this fat guy who
stole Bobby's card.
Fat guy: I told ya, I told ya, and I told ya. I lifted the cards from the
guy's wallet. It was just laying there.
Mike: Lying where?
Fat guy: Is this some kind of trick? I already said!
Helen: Then tell us again, Mr. Franco.
Fat guy (Franco): In the parking structure, on the ground, second level.
Mike: And you didn't roll the guy? (Lindsay is staring out the window) You
never saw Mr. Donnell at all?
Franco: Come on, detective. You got my record right there in front of you.
I boost and fence. Sometimes I kite a few checks, but I don't break heads!
I just took the guy's cards.
(Lindsay has had enough, and she opens the door and walks away. Helen and
Mike just look at Franco.)
------------------------------------
Scene: Hostage house.
(We see old pictures of little kids on the dresser. Bobby looks in the
corner and sees a walker.)
Bobby: You don't live here, do you?
Patrick: (looking out the window again) Yeah, I do.
Bobby: Having trouble walking lately?
Patrick: (turns around) That's my grandfather's.
Bobby: Does he know what you're doing here? (we see that Bobby is trying
to get his hands free)
Patrick: No. He died the week before I got out of jail.
Bobby: Were you two close?
Patrick: Are we bonding now?
(A noise is heard from another room. Bobby turns to see what it was and we
see just a closed door.)
Patrick: (running towards the door) You stay right there.
(he opens the door and goes in, shutting it behind him. Bobby tries
desperately to get the ties off as soon as he leaves. HE can't, so he
tries to get the thing around his neck that's attached to the gun off with
his feet. He lifts it up and succeeds in getting it off just the very
second that Patrick comes back. Patrick hits him hard over the head with
his fist and a gun. Bobby falls to the floor.
Patrick: (pointing the gun down at Bobby) I got nothing to loose. (Bobby
groans a few times) Nothing.
(Bobby looks into the room. We see a man with duct tape over his mouth,
sitting on the floor.)
---------------------------------
Scene: Crime scene, i.e. the parking garage. But it looks like they have
moved the car out to the street.
(Helen gets out of the car)
Helen: Don't be jumping to any conclusions. This can be very misleading.
(Eugene and Lindsay also get out of the car)
Eugene: Helen, we've been to crime scenes before.
(Lindsay walks to the car. She sees a man taking blood off of the car and
she has to turn around. She looks back at the car, a little scared.)
Eugene: You sure you want to be here? I could take you back to the office.
Lindsay: No. I'll be all right. (she walks back to the car) (another man
is taking a picture of the bloody hood.)
Helen: (to Mike, they're talking over by a police car) What do you got?
Mike: Not much.
Helen: Carjacking?
Mike: Possible. But most of those guys total the vehicle before they kick
it back. And looking at the blood on the hood--
Helen: I know. But I want the facts before I go there.
Mike: We'll do a typing.
(they turn to see Eugene and Lindsay walking up)
Mike: Hey, Eugene. (shakes his hand) Lindsay.
Lindsay: Do you have any witnesses?
Mike: We're talking to people now, but I want to be realistic.
Eugene: Meaning what, exactly?
Mike: They're not big on neighborhood watch in this part of town. Most of
the guys down here- They see a uniform, they think it's coming for them.
Helen: Do what you have to do to get answers. I'll look the other way if I
have to.
(Lindsay is just staring at the car)
-------------------------------
Scene: Hostage house, continued from earlier. Now the hostage is in the
room sitting on a chair and Bobby is sitting across from him on the
floor.)
Patrick: (to hostage) Sit right there.
Bobby: What's going on, Patrick? Who is he?
Patrick: You wanna know who he is? (pulls the duct tape off his mouth,
fast) Tell him who you are.
Hostage: Please, I don't know what this is all about..
Patrick: (slams the guy's chest hard with the gun and his fist) Tell him!
Hostage: Seymour Sternbach. Look, if I did something, I--
(Patrick clamps his hand over Seymour's mouth)
Patrick: That's enough.
Bobby: I don't get it, Patrick. What's going on?
Patrick: Seymour Sternbach. What, that doesn't ring any bells to you,
counsel? (Bobby shakes his head and looks confused) This is my exculpatory
witness.
Bobby: Your what?
Patrick: The man who could've cleared me! The man that you said you
couldn't find. The man that I found three days after I got out of prison!
The man you never even bothered to look for.
(Bobby just stares at them)
-------------------------------
Scene: The office. Ellenor is hanging up the phone.
Rebecca: Kidnapped?
Ellenor: Yeah. That's what they think. (her voice is getting a little
shaky)
Jimmy: By who?
Ellenor: They haven't figured that part out yet.
Rebecca: Random, or do they think he was the target?
Ellenor: I don't know, it could be either. They really just don't know
very much!
Jimmy: Kidnapped?
Lucy: So, what, they expect us to get a ransom call? Kidnapped for money?
Ellenor: (shrugs) I don't know.
(They all just kind of look at each other)
Scene: Hostage house. Patrick is looking out the window again.
Seymour: I swear, I don't remember!
Patrick: You're lying. You remember!
Seymour: I don't!
(Patrick walks over to him)
Patrick: You were there, Seymour. (hits him on the chest as he walks by)
Seymour: In a car, driving by, who would remember?
Patrick: (sitting) I remember. We talked that night.
(Flashback again. Patrick is in the car, and Seymour drives up.)
Patrick (V.O.): Yeah. You and me. We spoke. You were looking for a parking
space. I flagged you down, I told you I'd just be a minute, I was only
waiting for my buddy. And then we talked about your red mustang. Then you
saw another space open up, so you took that one instead.
Seymour: Look, who's going to remember a two minute conversation over a
parking spot 12 years ago?
Patrick: It was all over the news. The very next day. A double homicide
right where you were, and you're going to sit here and tell me you don't
remember?
Seymour: I don't! (Patrick punches him in the face)
Bobby: Patrick!
Patrick: Don't lie to me. (he starts pulling on his tie and it starts
choking him) Don't you lie to me.
Bobby: Patrick, you're gonna kill him! (a giant purple bump is developing
on Seymour's head)
Patrick: Tell the truth. Tell the truth!
Bobby: Patrick!!
(he finally lets go)
Patrick: Tell him.
(a pause)
Seymour: I was there.
Bobby: You remember talking to him? (Seymour nods) The night of the
murder? (nods again) Why didn't you come forward?
Seymour: Look, I'm a married man. I met a girl. If I'd come forward,
things would have been-
Patrick: Hey, hey. I did 12 years. You let me do 12 years because you were
cheating on your wife?
Seymour: Hey, for all I know, you could've killed those people after we
talked!
(Bad answer. He gets a slap hard across the face, which makes him and his
chair fall to the ground.)
Bobby: Patrick!
Patrick: (to Bobby) And you-- you should've found him.
Bobby: Even if we had found him, he doesn't get you off at all!
Patrick: Yes he does! (pulls him up off the floor)
Bobby: No! He just confirms that you were at the scene ready to drive the
getaway car! (Patrick shoves him in Seymour's chair) That's all the jury
needs!
Patrick: Only if I knew! (he's got the gun pointed at Bobby) I told you
that I had no idea what the hell Mickey was gonna do.
Bobby: Even so..
Patrick: Intent, counsel. Intent. Look it up. I did. Mens Reus. If I
didn't know what he was gonna do-
Bobby: But you helped him get away!
Patrick: He never got in the car!!
Bobby: But still, it was only your word!
Patrick: Why would I flag a guy down if I was there to commit a crime?!
(Bobby is silent.) Never thought about that, did you, counsel? (Bobby's
got a very confused look on his face) See that look on your face? (cuts to
a metal thing that's getting a reflection. In it you can see Bobby and
Patrick.) That's the look of a guilty man.
(Bobby just stares at his reflection)
Commercial. Take a deep breath. Halfway mark.
------------------------------
Scene: Bobby's office. Helen is walking around. Lindsay and Rebecca are on
the couch, Jimmy and Ellenor are standing.
Helen: What about previous threats? Did Bobby have any recent run-ins with
clients or witnesses that might have a vendetta?
Ellenor: We usually win.
Helen: No threats? No client you've screwed over?
(Ellenor looks at Jimmy)
Jimmy: What? I didn't screw anybody over.
(Mike walks in)
Mike: We may have got a break. Match on the prints from Bobby's car.
Name's Rooney. Patrick Kevin Rooney. (Lindsay looks confused, Rebecca is
searching her brain)
Rebecca: Patrick Rooney- I think we had a client with that name, but that
was a long time ago.
Mike: Makes sense. He just finished 12 years at Cedar Junction.
Rebecca: A manslaughter deal. I remember it because I'd just started
working here. (Takes the file from Helen) I think he's from Southie.
Mike: We're going over his full history now, but we'll need anything you
still have. (Rebecca nods and she and Lindsay start reading the file)
------------------------------------
Scene: Hostage house.
Bobby: Okay. Okay, maybe I should have found him.
Patrick: You screwed up. You screwed up!
Bobby: And if I did? It's too late to change the past. You want me to try
and get the record expunged?
Patrick: (sits down) You know what's been expunged? The past 12 years of
my life.
Bobby: Enough about the 12 years. I've heard about the 12 years. What
about the 10 years before that? When you were out committing aggrevated
assault and knocking off liquor stores, the 10 years before that. That's
the reason why I didn't out you in the witness chair. The 10 years before
that...
Patrick: Was the reason you assumed that I was guilty!
Bobby: Maybe it was and I'm to blame. But so are you. Who you were went
into my thinking. What you were. You have to take some kind of
responsibility for that!
Patrick: No! (there's a knock at the door. They all turn and look at it.
Patrick gets up.) You sit tight. Don't try anything cute. (He looks out
the curtain and opens the door enough to stick his head out.) (sweetly)
Hey.
(we see a girl at the door, Suzie.)
Suzie: Okay, Patrick. You got five minutes.
Patrick: Why don't you come inside?
Suzie: I'm serious, Patrick. I told you on the phone I've got nothing else
to say.
(He opens it more and she sees the gun in his hand)
Suzie: What the.. no, no, no! (starts to walk away, Patrick grabs her)
Patrick: Hey--
Suzie: Patrick!
(he shoves her inside and closes the door)
Patrick: Listen, I'm sorry. But I can't let you leave.
Suzie: Patrick...
Patrick: Come on, come on. (he leads her into the living room and she sees
Bobby and Seymour.)
Suzie: Oh my God!
Patrick: Come on, Suzie.
Suzie: Patrick, no!
Patrick: Come on. Sit down.
Suzie: Patrick, please..
Patrick: Sit. Sit down. (she finally sits and he sits by her) Listen. Hey.
Look, I don't want you to see me like this the first time, but I don't
have any choice now.
Suzie: What are you talking about?
Patrick: I had to make you see. Because of them (points to Bobby and
Seymour) I lost you. I lost everything.
Suzie: What?
Patrick: They'll tell you I'm innocent. (turns to Seymour with the gun
pointed at him) You tell her what happened.
Seymour: He's- he's innocent.
Suzie: Patrick, why are you doing this?
Patrick: Suzie, please. I'm not going to hurt you, I promise. Please. Stay
right here, okay? Relax, okay? (he gets up and goes to the kitchen) Im
gonna get you something to drink. I'll get you some tonic, all right? You
want some chips?
Suzie: You've got two men at gunpoint and you're offering me chips?
Bobby: Come on, Patrick. Leave her out of this.
Patrick: (slams the fridge) Leave her out of it? Leave her out of this?
She is the reason you're here right now, and she is the only reason you're
still alive! You understand me?
--------------------------------------
Scene: The office. All are looking through boxes of files.
Rebecca: It has to be here.
Eugene: Nice filing system you had, Bec.
Ellenor: Y'know, I don't see any dates on these folders.
Lindsay: Keep looking.
Lucy: What exactly are we looking for again?
Lindsay: Court docs, work products, list of personal contacts, anyone or
anything that might help us.
Lucy: We're going to be here all night.
Ellenor: I don't know why we're so shocked this happened. The people we
have as clients...
Eugene: All right, Ellenor.
Ellenor: No, I'm serious, Eugene. (The camera is focusing on Lindsay, but
we can see Ellenor in the background talking. Lindsay looks
uncomfortable.) Clients always blame their lawyers, even in civil cases.
OUr clients are murderers half the time going in. The bigger surprise is
that it doesn't happen more often.
(Lindsay leaves to Bobby's office)
Jimmy: I don't think she needed to hear that.
(Helen hangs up the phone and follows Lindsay into Bobby's office. Lindsay
sits in his chair.)
Helen: I am sure he is okay.
Lindsay: You can't be sure of that. I mean, who are we kidding? If this is
a revenge thing, the likelihood is he's dead. We both know it.
Helen: We don't know anything. This doesn't fit the typical--
Lindsay: We haven't heard from him. I mean, this Rooney guy? I mean, why
would he be taking him hostage? (Helen looks at her, concerned) We both
know the statistics, Helen. And the longer he's missing...
Helen: (strokes her hair) We'll find him.
Lindsay: (takes a deep, shaky breath) I- I don't- I don't know if I can
handle this, Helen. (she looks up at her with huge, fearful eyes.)
Helen: We'll find him.
Rebecca (off screen): Got it!
(They both get up and go into the main office)
Rebecca: Rooney had us send a copy of his appelment papers to his
grandfather, Seamus Rooney. The address is right there. (hands the file to
Lindsay and Helen)
Helen: All right, let's call Maguire. (dials phone)
(cut to Helen walking out of the office with Mike)
Mike: I have two backup cars there right now and a couple on the way.
Helen: No one makes a move until we get there, understood?
(Lindsay walks out, followed by Eugene, Ellenor, and Rebecca)
Lindsay: Helen! I'm going with you.
Eugene: We're all going.
Mike: Let's just go.
----------------------------------
Scene: Hostage house. Patrick is pouring (tonic?) into a tall glass.
Patrick: You want a drink, Suzie? (she puts her hand over her glass, and
we see a wedding band on her finger) (nods) I got it.
Suzie: I thought you knew.
(he puts down the tonic and sits)
Patrick: Who was I kidding, huh? 12 years, you don't come to see me once.
I should've figured it out, huh?
Suzie: I loved you, Patrick. What kind of a future did I have with you?
Especially after...
(pause)
Patrick: You got kids?
Suzie: Two.
Patrick: Pictures?
Suzie: Yeah. (pulls out her wallet.) That's Jake. (shows a picture) He's
7. And that's Johnny. (shows a picture) He's 3.
Patrick: They're beautiful. (smiles) I wish you could've stuck by me.
Helped me through the trial. We've known each other what, since seventh
grade? You don't even come to see me at the trail?
Bobby: She was a character witness, Patrick. Her testimony wasn't
important.
Patrick: Hey, it was important to me! She knew me. (turns back to Suzie) I
thought if I could make anyone understand it would have been you. (she
turns away) Now look at her. We were gonna get married. Now she's afraid
to even sit down and have a conversation with me. (Bobby looks thoughtful.
Maybe he's thinking about Lindsay.)
Patrick: This could have been my life.
Mike: (outside, through his little radio thing): Patrick Rooney!! This is
the Boston PD!!
(Patrick looks at them all. He stands up and grabs his giant gun. He
shoots the window twice.)
(cut outside, Mike and everyone else are amongst police cars and hiding
behind the doors)
Mike: No one will get hurt if you do as we say!
(He shows his face out the window)
Patrick: Hey, I got people in here! (he leaves the window)
Mike: That's him. Rooney. (on radio) Let's talk this out, Patrick. Tell me
what's going on.
(Patrick puts Bobby at the window. Lindsay sees him and a horrified look
spreads across her face.)
Lindsay: Oh my God! (she runs to Helen's side)
Mike: (holding up his hands) Are you okay?
Bobby: (nods, Patrick has the gun to his neck) We're all right.
Mike: How many are you?
Bobby: Three!
Patrick: Hold it right there. I said get back!
Mike: I'm not armed, Patrick. (he takes out his empty gun holder and sets
it on a car) See?
Patrick: You heard me. Get back! (he pushes the gun against Bobby's
throat)
(We see Lindsay and Helen standing close next to each other, looking very
worried)
Mike: Come on, Patrick. I want to help you. Tell me what you want, we'll
work it out.
Bobby: Talk to him.
Patrick: You shut up.
Mike: It's not too late to end this all peacefully.
Bobby: Come on, Patrick. You can get out of all this. Tell him you want an
offer.
Patrick: What are you talking about? No!
Bobby: (yells, to Mike) Talk deal and we'll consider!
Mike: Bobby....
Bobby: A deal! Give us something to work with!
Mike: You speaking for Rooney?
Bobby: (simultanious with Patrick) Yes!
Patrick: No! No! (he takes Bobby back inside the house)
Mike: (on radio, to other policeman) Let's get the snipers in place.
Commercial. Perfect timing as usual.
-----------------------------------
Scene: The street. Nighttime.
News Reporter: It's still unclear as to when the hostages were abducted.
Our sources say it began in the morning. We do know that the suspect's
name is Patrick Kevin Rooney, released just three days ago from Cedar
Junction, after serving 12 years for a double homicide. (this is now on
the TV inside the hostage house) One of the hostages is Robert Donnell,
the attorney of record who handled Mr. Rooney's murder trail 12 years ago.
Patrick: Yeah, mishandled is more like it.
Bobby: Patrick, you gotta decide what you wanna do here.
Patrick: What do you want me to do?! You want me to make a deal, huh,
Bobby? You want me to make a deal so you can go on with your life? Not
this time. No deals!
Suzie: Can't you see the man's trying to help you, Patrick? Or what, you
wanna die here in your grandfather's house? Real nice for his memory.
(Patrick walks to the window and looks out)
(Outside, Lindsay runs up to Mike.)
Lindsay: You had a clear shot there, why didn't you take it?
Mike: We try to negotiate first before shooting him.
Lindsay: Yeah, but how long do you plan--
Mike: Helen, please? (he hands her off to Helen)
(cut to Eugene, Rebecca, and Ellenor)
Eugene: This isn't good. The guy isn't even making any demands.
Rebecca: Which means?
Eugene: Which means he probably hasn't got a plan, which means he's
probably out of control.
Ellenor: They should just take him out.
(cut inside)
Patrick: This wasn't supposed to happen. Not like this.
Mike: (outside) Patrick, are you listening to me? (Patrick looks out) Come
out now and we'll work something out. I promise.
Seymour: He promised!
Patrick: Shut up, you!
Bobby: Patrick, your mission here, as I understand it, was to show me and
Suzie that you didn't do the crime. To convince me that I screwed up by
not believing you and finding this witness. You've done all this!
Patrick: (shakes his head) That was only half of my mission. The other
half was to kill you.
Bobby: (yelling) Then do it! And get it over with!
Seymour: Don't antagonize him, for God's sake!
Patrick: Fine! (Bobby gets the gun to his neck)
Bobby: In which case the police will be charging in to shoot you!
Suzie: (runs and grabs Patrick's arm) Stop it!
Bobby: There is a way out. Let me talk to them. If I can get you out of
this, Patrick, let me try. Let me try.
Patrick: No. No!
Suzie: You don't want to die in here, Patrick. You can't want to die.
Patrick.
(long pause)
Patrick: All right. Let's go. (pulls him up) You stay where I can see you.
(brings him to door, Bobby walks onto the doorstep.)
Mike: Hold up, everybody. Hold up!
Bobby: We're ready to talk.
Mike: All right, Bobby. Go to the phone.
Bobby: Not you, Mike. Someone who can make good.
(cut inside, phone ringing) (Patrick picks it up and puts it up to Bobby's
ear)
Bobby: Everyone goes free in exchange for charges dropped.
(cut outside)
Helen: Bobby...
(cut inside)
Bobby: Helen, that's the way it's gotta be.
Helen: Can he hear us?
Bobby: (looks at him) No. That's the offer.
Helen: All right. Tell him to send out the hostages and we will drop all
charges.
Bobby: That won't work. You gotta do better than that.
Helen: Ugh. All right, all right. Tell him we'll keep the parole
violation.
Bobby: Suspended sentence.
Helen: Whatever.
Bobby: You're not listening. He isn't doing time! We agree to no time or
there's no deal. The guy's got a gun, he's about to shoot me.
Helen: Okay, uh, I'm juts gonna keep talking so it looks like we're
responding. Uh, Lindsay's doing okay, we're all taking care of her. Bobby,
we'll get you out.
Bobby: That's the only deal we're making. (nods to Patrick that he's done.
Patrick hangs up the phone) Okay. Here's the offer. They won't file on
kidnaping, assault, or false imprisonment. But the parole violation
stands.
Patrick: No. (walks away)
Bobby: Patrick, this is on the news. They can't just tell the public they
let you walk free! I have Helen Gamble's word she will agree to a
suspended sentence on the parole violation, so in essence, you will be
walking free.
Patrick: No judge is going to sign off on that!
Bobby: The judge will go along if we can show you were wrongly accused.
(to Seymour) We'll need you for that.
Seymour: Fine.
Bobby: You can get out of all this, Patrick. All of it. It's not too late.
It's not too late.
Patrick: No. I want your life ruined. I want your life ruined just like
you ruined mine.
Suzie: Patrick, you want the world to know that you're not a murderer.
(loooooooong pause)
Patrick: I won't go back to prison?
Bobby: No.
Patrick: You leave last.
(cut outside, a teeny bit later)
Reporter: We're told the police have made dialogue with the suspect and an
arrangement may have been made to release the hostages.
(Helen walks over to Mike)
Helen: What is happening?
Mike: I'm not sure.
(Seymour runs out of the house)
Eugene: Who's he?
Ellenor: I have no idea.
(the police take Seymour into their mob of people)
(cut inside)
(Patrick walks away from the window and to Suzie)
Patrick: All right, Suzie.
Suzie: (stares at him a while) Bye.
Patrick: I didn't do it.
Suzie: I know, Patrick. I know. I'm sorry. I'm sorry.
Patrick: Maybe I'll meet your kids someday, huh? (she's silent) All right.
(softly) Get out of here.
(Suzie walks out with her hands up and Mike takes her)
Mike: You okay?
(cut inside)
Patrick: You got a girl?
Bobby: Engaged. She's out there-- scared to death.
Patrick: She's special, huh?
Bobby: Yeah. (pause) Look, I'm sorry. I should've found that witness. I'm
sorry.
Patrick: You talked about the 10 years before. My priors. The last two, I
was clean. I was getting my life together. Maybe I could've been a lawyer
or something, who knows.
(he notices the man on TV talking)
Man on TV: It really wouldn't matter what the DA was offering in terms of
a plea.
(Patrick glances at Bobby, who looks like he's just been found out)
Man on TV: They could, in effect, promise the suspect anything under the
sun and then vitiate the deal on grounds of duress.
Patrick: What does vitiate mean? What the hell does vitiate mean?!?!
(silence) There's no deal, is there? You've screwed me again.
Bobby: (quickly) The DA, she agreed-
(Patrick fires the gun and it hits inches from Bobby's shoulder)
Patrick: (yelling) Is there a deal or not?!
Bobby: There's a deal.
(he shoots again, same place)
(cut outside, Lindsay has just heard the shots)
Lindsay: Bobby. Bobby!! (She starts running towards the house)
Mike: Get her out of here! (a policeman stops her and brings her back to
Rebecca)
News Reporter: We can't tell exactly what's going on, but we just heard
the sound of gunfire coming from within the house, where the gunman is
still holding Bobby Donnell, the Boston attorney.
Mike: (on radio to his snipers) Sierra one, if you can get a shot.
(cut to a sniper's view of the window, his gun pointed straight at it)
Mike: (on radio, loud this time) Patrick! Patrick, if you could hear me...
(to policeman next to him) Dial the number. (he does) Patrick, pick up the
phone. I need you to answer the phone!
(cut to Lindsay, Rebecca, and Ellenor. Lindsay is wiping a tear from her
eye)
(We see Patrick bringing Bobby out. He's got the gun back at his neck.
Lindsay sees him and begins to cry)
Patrick: Anybody does anything, and he dies!
Bobby: Patrick...
Patrick: Shut up! (pushes the gun harder against his throat) You hear me?
Mike: What do you want?
Patrick: I want you to send in the DA. And only her.
Mike: Patrick, we can't!
Patrick: I know she's out there. Send her in!
Mike: (to sniper) You got a shot?
Sniper: Barely.
Mike: Patrick, release Mr. Donnell and we'll send in the DA.
Patrick: No. No way.
Bobby: Patrick, please!
Patrick: You send her in right now, or he dies!
Mike: If you release Mr. Donnell--
Patrick: He dies on the count of 3. Do you understand me?
Helen: Let me go.
Mike: (holds her back) Not a chance. (awww...) Patrick!
Patrick: One....... (Lindsay is really really crying now) Two....
Mike: (to sniper) Take him.
GUNSHOT!!!
(Lindsay gasps. She thinks for sure she's lost him now. Patrick falls,
taking Bobby with him. Mike smiles and hits the squad car next to him. His
team moves in. They pick Bobby off of Patrick. He stumbles out into the
street. Lindsay sees him.)
Lindsay: Oh my God. (she runs towards him and Rebecca, Eugene, and Ellenor
follow her. She finally reaches him and hugs him as tight as she can.
Eugene unties Bobby's hands and he wraps his arms around her. She pulls
away and looks at his face, then hugs him again.)
-------------------------
Scene: Outside. Kinda. We see a body bag on a stretcher.)
News Reporter: One single gunshot wound to the head, Mr. Rooney went down
immediately. The hostage, Robert Donnell, was unhurt. (this is where the
kinda comes in. We now see that Bobby and Lindsay are sitting in bed
watching the TV.) Patrick Kevin Rooney was pronounced dead on the scene.
Police homicide detective Mike Maguire spoke later about the incident.
(Lindsay turns it off. Neither say anything for a while. Bobby looks to be
deep in thought)
Bobby: I did screw up his case.
Lindsay: (kind of rolls her eyes) Bobby...
Bobby: I was right out of school. Taking three assignments a clip, 17
hours a day, trying to scratch. I trusted the DAs then. If they told me he
was guilty, I believed them. I probably did push that deal on him without
even bothering to track down the witness. Took one look at his rap sheet
and prejudged him. And I doubt- I doubt it was the only time.
Lindsay: (takes a breath) I thought I'd lost you.
Bobby: The whole time, all I could see was your face.
Lindsay: (kisses him on the cheek) It's over.
Bobby: Your face. And all I can see now... is his.
