"Closet Justice" summary by Melly Written by: David E. Kelley Directed by: Alex Graves Plot 1 - The nun killer The episode starts with Helen watching TV. Apparently a nun had been stabbed 30 times and Helen is the DA representing the Commonwealth. She is not happy about this, but Lindsay compliments her, telling her that it's a high profile case and that she may be stopping by to see the arraignment. This turns out to be a huge mistake as judge Hiller sees her during the arraignment and orders her to represent Michael Kingston, the nun killer. Joseph Mapp was originally assigned to represent him but being public defender judge Hiller feels that someone better should represent him, namely Lindsay Dole. Naturally Lindsay tries to decline but judge Hiller tells her "Counsel, this wasn’t a request. It’s your case." Bobby and Lindsay go to see Judge Hiller in her chambers to try once more to decline her orders but without success. They tell her that she can't order them to defend him but she tells them that is exactly what she is doing. Later on, the lawyers of DYF&D have a meeting about the case (all there except Jimmy and Rebecca see plot 2). They argue. Bobby tells Lindsay to go and see the client to which she sarcastically replies "Oh, great!" Lindsay goes to see Michael Kingston. He acts like he doesn't really care and comes on to Lindsay. He asks her if this is her first case and tells her that she has a little virgin thing going on. Lindsay tells him that she considers him pretty stupid and that he disgust her. Helen goes to church, to see other nuns and talk about sister Caroline. She doesn't want to be surprised by anything in court. They tell her that she wanted to help Michael Kingston. Sister Caroline approached him to help him as he'd come to church angry, despondent... Helen tells them that she'll put the guy in jail. Meanwhile, Lindsay is still talking to Michael Kingston about what and how it happened. As she walks out of the prison she is met by loud, angry mob of protesters. She gets hit by some eggs. When she gets to office Lucy helps her to get egg shells out of her hair. Bobby decides to be with her every step. Bobby asks Ellenor to go and see the girl that was in Michael Kingston apartment, the one that called the police as she found herself locked in the apartment, Cynthia Simonson. Bobby goes to see Helen and asks her for life with parole, but she declines and tells him there in no way that this guy will be back on the street again. She shows him photos of the scene... But Bobby tells her if she doesn't offer something they have no choice but to go to trial. Lindsay and Ellenor have a meeting with Cynthia Simonson upon which they discover that the search of the apartment was illegal. When they go back to the office Lindsay tells Bobby that they may be able to suppress the chopped up nun. If the police officer that preformed the search says what he was going to say than they'll rise the Fourth amendment issue and suppress the content of the closet where the nun was found. Later on, in court, Ellenor questions the police officer and he admits that he did not have authority to open the closet at which point Ellenor asks to suppress the entire contents of that closet. Everyone in courtroom looks surprised and shocked, except of course Bobby and Lindsay. Judge Hiller asks to see the lawyers in the chambers. Helen is making her argument, while our lawyers are making theirs. Judge Hiller tries to interrupt them, but they just talk. When she does get to say something. she asks about the life parol offer. Bobby tells her that the offer is withdrawn. We here some more arguing between judge Hiller and Bobby. She tells them that she'll here all arguments tomorrow. Helen tries with everything she can to find something before 10 o'clock tomorrow. Judge Hiller goes to see judge Kittleson asking for advice, as she's faced with no choice but to free the nun killer. Meanwhile back at Lindsay and Helen's apartment, Helen is clearly very upset. They start fighting, Helen can't believe that Lindsay represents the guy. She is making everything personal now. Lindsay tries to stay calm, but they both end up yelling at each other. Helen is on the verge of crying. Lindsay walks away to her room slamming the door behind her, leaving Helen crying. Next morning, it appears that Helen had spent all night awake, working on the case. She apologizes to Lindsay about last night. Later that morning they both deliver their speeches before judge Hiller. It seems that Helen read a lot last night, including everything about the fourth amendment. It's very emotional, but it doesn't look it'll help the case. Lindsay gets really upset when Bobby tells her that he wasn't very pleased with her argument and that he's seen her better. Judge Hiller makes her decision and we are back at court again. She starts by saying that she agrees with Helen and goes on and on why she thinks that in some cases fourth amendment should be and is interpreted and expanded by the courts for the purpose it is indented but at the same time she knows that the Supreme court made clear rulings on the fourth amendment. Hence she finds the search of the closet was illegal and sets the defendant free. Kingston smiles as he's freed, while Helen and Lindsay are both on the verge of crying. They both get up and meet at the half way between their tables. They look in each other eyes and then they hug, both crying... Plot 2 - Jimmy, Rebecca and the client facing solicitation charges Jimmy and Rebecca have a client,Mr Burrows, facing solicitation charges. Apparently what happened is this: He was sitting in a bar, a woman came up to him, started flirting, they talked he found her to be very attractive. However later on she tells him that she's a prostitute and after a while asks him if he wanted to go his hotel room. When they went upstairs to a hotel room he paid her for her "services" at which point she tells him that she is a police officer and arrests him. Jimmy is optimistic, he thinks they could win, but Rebecca doesn't seem to be. After all he did commit the crime. Jimmy goes to see Judge Kittleson and asks her to make his argument before her... She gets upset, she hates when people use personal relationship to ask her favours. She tells him: "once I put on that robe, I don’t play favourites for anybody"... Jimmy gets upset, but Kittleson hugs him and they make up. At the trial the police officer is questioned, first by opposing counsel, upon which we discover that she charged him $400, and then Jimmy. Basically their defence is entrapment, so Jimmy asks to see the officer dressed the way she was that night. Judge agrees and they are adjourned for one hour. After the hour we are back in court again. The police officer is dressed in a nice tight black dress. Jimmy asks her to turn around and stand on each side so that everyone can see the way she was dressed from all angles. Then he asks her to hold the foreman hand and smile at him. She does so, and the foreman smiles back at her. Tisbury, the opposing counsel is of course objecting to all this. Later on Borrows takes the stand. He feels that he was led into committing the crime. He says: She got me as thirsty as she could and she led me to a trough and then I get arrested because I wanted to drink. Then it's Tisbury's turn. He manages to get Mr Borrows angry by telling him that he agreed to pay for the lady's services. Mr Borrows is upset that the Government has done this to him, caused him to break the law and now he has to pay. He tells him: maybe you should litter the streets with twenty dollar bills next and bust the homeless for when they don’t turn them in. Jimmy and Rebecca are upset that he said what he said while he was cross examined. And as they walk into an elevator they argue about this. Mr Borrows tells them that he's angry and a weak person, and all this just isn't fair. Next morning both Jimmy and Tisbury deliver their closing arguments. Jimmy talks about entrapment, what it is and how this case is exactly that. His argument is very well done. And it's no wonder when we later find out the not guilty verdict. So Jimmy, Rebecca and Clyde Burrows go celebrate at a bar. Judge Kittleson stops by to tell Jimmy that they won't be having dinner as planed. She has to go to check on judge Hiller whose just about to give her ruling (see plot one)... Rebecca looks questioningly at Jimmy, to which he defensively replies : we are friends.
