The functionality of Conference of Rulers

The conference of the Malay ruler or 'Majlis Raja-Raja' dated back in July 1897 had been held for the first time in Kuala Kangsar and every year in the month of August all the Sultans of the Malay states including my uncle here Sultan Abdul Halim Shah Ibni Sultan Badlishah had been attending this unique congregation pertaining to the Islamic and Malay issue at large.


These are the primarily function of the ruler;


(1) Election of the King, under Article 38 (2) the conference has the important constitutional function in the election of the Yang Di-Pertuan Agong.


(2) Dismissal of the King, under Article 38 (6) the conference hold the right to terminate the Agong if he's deem unfit.


(3) Legislative Veto, the conference has the right to veto federal legislation on sensitive issues sepecially regarding the rulers interest under Article 38 (1); any law altering boundry of a state Article 2 (b). Any amendments shall not become a law without the approval of the conference as stated in Article 159.


(1a) Amendments that violated the rulers: Article 38 (4);                               (1b)Amendments regarding the precedence of the rulers: Article 70;       (1c) Amendments Article 71 (1) that guarantees right and privileges of the ruler to succeed to the state throne;                                                                          (1d) Amendments to sedition law prohibitting the questions of sensitive issues: Article 10;                                                                                                               (1e) Amendments to Articles 63 (4) and 72 (4) that curtail free speech to avoid seditious remarks,                                                                                                   (1f) Amendments to Article 152 dealing with Malay language as the national language;                                                                                                               (1g)Amendments to Article 153 on special privileges of the Malays,              (1h) Amendment to provisions of Part III regarding citizenship.


(4) Appointments, the conference consultation is needed for the election in federal post. Among them are; judges of superior court, Auditor-General, and CEO of Public Services Commision and the Election Commision.


(5) Religion, the Sultans are Islamic heads in their states. But to promote unity the conference can approved and disapproved on the religious acts by the Federation government. 


(6) Privileges, Article 38 (5) requires the conference be consulted before any changes in policy to tyhe priviliges to the Malays are made.


(7) Pardon, under Article 42 (5) the conference may exercise the power of pardon in relation to the Agong, the Sultans and their consorts after considering the Attorney-General.


(8) Special Court, if the Sulatn is subjected to judicial proceedings, Article 182 requires that the action be commenced in a Special Court of five judges, two of whom shall be nominated by the conference itself.


(9) National Policy, under Article 38 (2) the conference has been given to deliberate on questions of national policy and other matter it thinks fit. 


The wisdom and attendance by the conference of the ruler is much needed by the government of the status and experiences but their views remains not binding and subjected to advisory.
