I sent them this email: I post on the Sissyfight message board. www.sissyfight.com A sissy created an icon for me to use. She said she gave it to me, free of charge. She never said anything about being able to revoke her permission for me to use it. However, now she says she doesn't want me to use it anymore. She says she owns the copyright. My question: is the icon still mine? She did give it to me. Do I have to stop using it? I am waiting for their reply. Here's the PM that started it all.... I'm afraid, due to the lovely little loopholes in the law, that it is not your property. Regardless of how you consider it. I call those loopholes lovely because they are there to protect artists like me who know how to use the law to protect our intellectual property. It's being banned for violating the honor code, or further to that, being pursued by law. I know my rights, Audrey, and I've tried to make that blatantly clear. I work as an artist. Audrey, If you wrote to Claudia at the word.com address, there's a good chance he did not receive your email. As far as I know, the word.com addresses are still not functioning. If you would like send that email again, please send it to me at this address and I will forward it to him for you. RamonaQ AH, You're right that this is a legal matter between you and Delphia. We cannot make a legal ruling on this matter, for obvious reasons, nor would we wish to. So at best we can say that it's unclear who the icon belongs to. One of the claimants, Delphia, has complained to us about your use of the icon. Therefore, we have to ask that *nobody* use the icon until its status is resolved, either by agreement or in court. Naturally, it seems preferable that you and Delphia work it out between yourselves. Unless both of you agree on how the icon can be posted, we can't allow it. That's why your posting priveleges are temporarily suspended. If you agree not to post it, we may grant you the privelege of using our board again. It would be another matter if this was a clear-cut matter either way, but for reasons that I explained before, Delphia has a very good argument for why the icon belongs to her. You have your own arguments as well, which are not outside the realm of common sense. So, since the status of that icon is unresolved, we can't allow it to be posted. If you'll let me back on the boards then I'll agree to stop using the icon. However, if that website favors me, then I'd like to use it again. We're doing inventory at work today, so I won't be home til very, very late. so I may not get your email until tomorrow. Anyway, I hope we can work this out. I'm tired of worrying about it. AH |
