It is hereby agreed and understood by and between the Schenectady Municipal Housing Authority (hereinafter referred to as SMHA

____________________________________________ in the City of Schenectady and belonging to the adjoining property owner, pursuant to the terms and conditions set forth herein:

1. LOCATION OF PROPERTY: Contiguous parcels located at

__________________________________________________ Schenectady, New York

2. PURPOSE: The purpose of this consent is to allow and grant permission for the SMHAs contractor to

_____________________________________ situated on __________________________, upon property belonging

to_________________________, by entry upon the private property of the undersigned adjoining property owner.

3. SCOPE OF WORK: ___________________________________________________________

SMHA agrees to restore adjoining property to its original condition (depicted in the attached two photographs) should damage to the adjoining property occur. The parties agree that said photographs represent the condition to which the adjoining property shall be returned upon completion of the above work.

4. TERM OF CONSENT: Adjoining property owner agrees that the consent granted herein shall last until the scope of work is completed.

5. INDEMNIFICATION: The SMHA agrees to save and hold the adjoining property owner harmless of and from any claims, actions, and judgements of any kind that may arise due to the execution of work allowed under this agreement.

6. LIMITATION OF LIABILITY: The HA does not, by performance of the work allowed by this consent, assume or otherwise become liable for any claims, actions, or judgements that may arise from any pre-existing or other condition not directly related to the work described herein.

7. ACCEPTANCE OF WORK: The HA will, as soon as practicable after the completion of work under this agreement, make a complete inspection of the entire work.

8. ACCESS TO WORK: The undersigned adjoining property owner hereby agrees to allow the HA contractor to enter upon the adjoining property to access the work site.

9. INSPECTION: The HA will inspect the work of its contractor employed by it to as ascertain and ensure that the work is being done in accordance with the scope of work stated herein.
