Board Meeting - September 5, 2007

The meeting was called to order at 7:06 P.M. In attendance were board members: Brian Starr, Ty Baden, Julie Flowerdew and Mike Wasnorowicz. Members present were Diane Thyben, Joan Wallace, Kim Beasley, Joe & Diane Cruz, Nanette O’Grady, Shearalon Syder. Guests present were Leroy Desamours, Craig O’Grady and Jessica Medoro.

It was noted that 4 board members were present constituting a quorum and therefore HOA business could be conducted.

It was noted that only the board would be recording the meeting.

It was noted that all the board members had read the minutes from the August 2007 board meeting. Brian Starr made a motion to approve the minutes from the August 2007 board meeting. Ty Baden seconded the motion. Julie Flowerdew, Brian Starr and Ty Baden voted yes and the minutes were approved.

Kim Beaseley presented the board with an ARC form to be approved at a later date.

Brian Starr noted that the only amendment that passed was the fence amendment and that it had garnered 35 votes. Mike Wasnorowicz noted that he had filed the new amendment with the county clerk’s office and had posted the amendment on the HOA website.

It was noted that we had received payment in full of the annual dues from 100 Shaddock from the new owners.

It was noted that letters had been sent to the owners of 121 and 134 Evergreen giving them 45 days in which to pay their annual fees or foreclosure proceedings would be started.

It was noted that there were no new unresolved violations since the last board meeting

After a brief discussion, Brian Starr made a motion to keep the gates open on Sundays from 11AM until 4PM to allow potential home buyers access to the community in hopes of helping the members sell their homes. Julie Flowerdew seconded the motion. Brian Starr, and Julie Flowerdew voted yes. Ty Baden voted against. The motion passed.

Mike Wasnorowicz presented the board a spreadsheet with an analysis of the financial condition of the HOA. It was noted that if all the dues are paid and the other amounts owed by the members are paid, there would be no special assessment this year.

The floor was opened for new business.

Mike Wasnorowicz asked the board for a clarification of the declaration Article V, Section 20 (e) concerning what constituted parking on the street overnight. He recommended adopting a community rule, which would define a start time and an end time for the no parking restriction. After discussing the issue, Brian Starr made a motion to adopt a community rule, which defines overnight parking as parking on the street between the hours of 12 midnight and 6AM. Julie Flowerdew seconded the motion. Everyone voted yes and the motion was passed.

Julie Flowerdew made a motion to adjourn the meeting. Ty Baden seconded the motion. Everyone voted yes and the meeting was adjourned at 7:37 PM.
