Turnover Meeting
March 30, 2005
The Turnover Meeting was called to order at approximately 6:35 P.M.. Those in attendance were Juan Adames, Jose Arroyo, Ty Baden, Raed Bader, Melvin Bass, Cheryl Brunner, Ronald Johnson, John DeMarco, Rose Marie Gervase, Kevin Gervase, Pamela Gervase, Diane Thyben, Beatris Marcano, Bob Reynolds, Antranette Robinson, Terri Sigismondi, Eric Sigismondi, John Sims, Brian Starr, Gregory Syder, Joan Wallace, Bill Wallace, Michael Wasnorowicz, Susan Wasnorowicz, Chuck Reeber of Maronda Homes and Michele Noriega of Lakeland Properties & Management, Inc. Units represented by proxy were 123 Evergreen- John/Julie Flowerdew (proxy to Susan Wasnorowicz) and 121 Evergreen Drive – Karen/Jeremy Benforf (proxy to Rose Marie Gervase).
Due to the withdrawal of the developer early in the development, some documents are not available. Lakeland Properties has been provided with a deed to the wetlands area, engineering drawing showing underground water service and is talking with TECO to get drawings on the underground electric as well as the lighting contract. The Association had apparently not been kept active and Maronda Homes reactivated the association. The required number of owners had approved the appointment of a board consisting of Chuck Reeber, Gus Hevia and Greg Carlson to manage the Association until turnover. Those officers have submitted their resignations in order to turn over control of the Association to the owners. George DeMarco questioned that and suggested that the turnover not be accepted. Maronda has met the legal requirements of maintaining control until a certain percentage of sales had occurred and they have resigned. A homeowner said that the last lot had been closed on ‘today’. The Association is being turned over.
The owners wanted Maronda to be responsible for street signs which Lakeland Properties has and has had for months but is unable to put up because of not being sure of underground utilities. The signs will be put up as soon as possible. Maronda has fixed the damaged curbing, irrigation along the street, the white fence along the street and the column at the entrance. A street sweeper will also be out to clean up the construction dust/dirt and Maronda will clean out the storm drains. The repair of the front column was questioned. An owner said it had been done with cement instead of brick; Maronda will look into that.
The question of payment of 2004 association dues by the first home buyers was brought up. Neither Maronda nor Lakeland Properties has any records of that. The law firm of Stanley Wines sent some funds and Kampf Title has sent money on all closings starting in approximately July, 2004. Maronda has deficit funded the association until funds were available from these closings.
The meeting started to get tangled up in numerous clerical question and complaints. Mike Wasnorowicz made a motion to continue with the meeting; Eric Sigismondi seconded the motion. All were in agreement.
The question was asked concerning the responsiblities of the board. The Board is responsible for making sure the dues are collected, enforcing the documents and maintaining the common areas. A homeowner said that the documents restrict the size of satellite dishes to a size that is no longer available. The Board will have the responsibility for formulating rules and can handle the satellite question in the rules. Fences and any other exterior changes were discussed. Permission for desired exterior changes must be submitted in writing to the Board of Directors. One homeowner did request permission for a fence which was approved. The approval was for the black chain link fencing with landscaping in front of that. This approval was requested of Maronda who preferred to wait until the turnover was complete but had to make the decision sooner. The documents discourage fencing but restrict the height of fencing to 4 feet.
In an attempt to complete the turnover, nominations were made for directors to the Board. Cheryl Brunner nominated David Brunner; Kevin Gervase seconded the motion. Atranette Robinson nominated George DeMarco, Brian Starr seconded the motion. Eric Sigismondi nominated Pam Gervase; David Brunner seconded. Michael Wasnorowicz volunteered; Terry Sigismondi seconded. Kevin Gervase nominated Antranette Robinson; Cheryl Brunner seconded. Ty Baden nominated Susan Whitney; Raed Bader seconded. Pam Gervase nominated Eric Sigismondi; Susan Wasnorowicz seconded.
There being no further questions for Chuck Reeber, the turnover meeting was adjourned at 6:35 P.M.
