Board Meeting - May 2, 2007

The meeting was called to order at 7:09 P.M. In attendance were board members: Brian Starr, Ty Baden, Julie Flowerdew and Mike Wasnorowicz. Members present were Diane Cruz, Bill & Joan Wallace, Tatiana Desamours and Kevin Gervase.
It was noted that no one would be tape recording the meeting, except the board.
It was noted that all the board members had read the minutes from the April 2007 board meeting. Brian Starr made a motion to approve the minutes from the April 2007 board meeting. Julie Flowerdew seconded the motion. Julie Flowerdew and Brian Starr voted yes and the minutes were approved.
It was noted that Antroinette Robinson had not submitted plans for her koi pond project as requested by the board and that she had removed the koi pond from her backyard. The board assumed that the owner abandoned this project and that an approval for that project was not needed.
An ACR form was submitted by Tatiana Desamours for an in-ground swimming pool project. After review, the board approved the project.
Current violations were reviewed. 114 Shaddock Drive (Antroinette Robinson) was now not in violation. 104 Shaddock had removed the leaning trees and the concrete forms and was now not in violation. 100 Evergreen was noted as still being in violation for not having removed the weeds growing through the front fence. No new violations were noted.
The board discussed lawns in general. There are several lawns not conforming to community standards. The owners are not irrigating or spraying for bugs or fertilizing their lawns. Letters will be sent to each member whose lawn is in question telling them what they need to do to comply with the declaration.
Agenda item number 7 (Approval of common are violations and penalties) was tabled until later in the meeting.
It was noted that the gate operating instructions had not been addressed during the month and would be tabled until the next meeting.
Brian Starr informed the board that he called several electricians and that they wanted upwards of $75 just to come and look at the front gate electric box. Brian decided to purchase a lock for the electric box in hopes that would solve the problem.
Agenda item number 7 was taken off the table. Mike Wasnorowicz read a document entitled "Community Rules & Penalties for the Use of the Common Areas" (see below attachment to the minutes). Brian Starr made a motion to adopt these rules as written and amended. Julie Flowerdew seconded the motion. Everyone voted yes and the rules were adopted.
The amendment process was discussed in great detail.
The language for the amendments to Article V Section 9, Article V Section 19, Article V Section 24 was reviewed, discussed and approved. Mike Wasnorowicz noted that he would now send the proposed amendments to the HOA attorney for approval and the creation of the ballots.
It was noted that if the litigation between the HOA and the two members suing the HOA continues, there would have to be a special assessment to cover the budget shortfall caused by the legal fees associated with this litigation. There was a lengthy discussion of that litigation.
Julie Flowerdew made a motion to adjourn the meeting. Brian Starr seconded the motion. Everyone voted yes and the meeting was adjourned at 8:55 PM

Whereas Article VII, Section 1 of the by-laws of Shaddock Estates states, "The Board of Directors shall have power to: a) adopt and publish rules and regulations governing the use of the Common Areas and facilities, and the personal conduct of the members and their guests thereon, and to establish penalties for the infraction thereof;" the following rules and penalties have been adopted:
