Board Meeting  - July 5, 2005

Auburndale Public Library

 

The meeting was called to order at 6:32P.M.  In attendance were Susan Whitney,  Pamela Gervase, Michael Wasnorowicz, Brian Starr and Scott Munroe. 

 

The most recent financials from Lakeland Management were distributed.

 

The option to levee fines on HOA rule violators was discussed.  It was stated that, per documents provided by Michelle Noriega at Lakeland Management, HOA members could be fined $100 per day up to $1000 total fine per incident.  Members need to be given 14 days notice of the fine.  It was decided that the 14 days notice would be sufficient in almost every case, to rectify the violation, and that the fine would be levied at the rate of $100 per day until the violation was rectified or the $1000 limit was reached.  It was also noted that the fine would then have to be collected in small claims court.

 

It was discussed that we need to engage a towing company and post signs stating that cars will be towed if parked overnight in the common areas.  This would hopefully deter HOA members from parking on the street overnight.  It was also discussed that cars parking on the street or blocking the sidewalk without being in the street create a libelous situation and that, according to the declaration, is a violation. 

 

Painting the gutters yellow as a warning was discussed.  Pam Gervase noted that someone she knew tripped and strained her ankle. 

 

It was discussed whether or not the board should post HOA violators and what actions the board was taking to address those violations, in the newsletter among other places. 

 

The matter of Jack Simms being delinquent with his 2004 HOA dues was resolved.  It was noted that Mr. Sims had paid his fees to the existing HOA, Mr. Faulks.  Regardless of what happened to that money, Mr. Simms met his obligation and the amount he owes should be forgiven.  Michelle at Lakeland Management will be notified and a letter will be written to Mr. Simms exonerating him of any wrongdoing. 

 

All current violations were reviewed.  Antroinette Robinson was noted as having an illegal lawn decoration.  Bill Wallace was noted as having illegal lawn decorations.  Charmaine Daley was noted as having lions and other lawn decorations as well as lions attached to her house, which are in violation.  Mr. Just was noted as having removed the sod in his backyard and replaced it with stone, which is a violation.  Michelle Adamson was noted as having benches on her front lawn.  A new violation letter will be sent to the above violators with a letter explaining the fine process.  They will be given 14 days in which to rectify their violations or fines will be levied on them. 

 

New violations were discussed.  Jody Myers was noted as parking his boat in the street frequently enough to be considered a violation.  The members at 104 Shaddock were noted as parking in the street nightly.  This is definitely a violation.  It was noted that

Aubry Exum has ATV’s and a trailer parked in his driveway.  The trailer and ATV’s are sometimes parked overnight in the street. 

 

Community day was noted as still being set for 7-23-05 at 9A.M.  It was decided that we would be buying mulch for the front entrance and common areas. 

 

It was noted that the HOA was offered free azaleas but we would have to transplant them by this weekend.  Volunteers would be needed to do this.  Thursday at 7:30PM will be the time to meet for the azalea transplant.

 

The delinquent dues list was reviewed for accuracy and completeness.  It was noted that Casey Golden’s name needed to be changed to the new owner’s.  It was decided to put a notice in the next newsletter that as of the September 1st newsletter, delinquent homeowner’s names will be published.  It was also noted that delinquent homeowners do not have a vote or a voice in HOA matters until their delinquent amount has been paid.

 

It was decided to see how much it would cost to change our corporation from a non-profit organization to a HOA organization.  Mike Wasnorowicz volunteered to contact Michelle Noriega to get a recommendation for an attorney.

 

The need for another member meeting was discussed.  It was decided that another meeting was not needed as of this time.  It was decided that we would take a wait and see attitude before calling another member’s meeting.

 

The issue of the missing sidewalks discussed.  Mike Wasnorowicz volunteered to wait until July 15th so see if the sidewalks become installed.  If not, he will contact C&M builders to find out what to do to get the sidewalks installed.  He will also send a letter to Melvin Bass and Bob Reynolds explaining that the HOA will retain the services of C&M to get sidewalks placed in front of their house. 

 

Creating an HOA web Page was discussed.
