Board Meeting - January 3, 2007

The meeting was called to order at 7:15 P.M. In attendance were Jose Arroyo, Ty Baden and Mike Wasnorowicz. Also present was Juan Adames. Brian Starr arrived later in the meeting.
It was noted that all the board members had read the minutes from the December 2006 board meeting. Jose Arroyo made a motion to approve the minutes from the December 2006 board meeting. Ty Baden seconded the motion. Ty Baden and Jose Arroyo voted yes and the minutes were approved.
Jose Arroyo made a motion to reduce the fines levied on 100 Shaddock Drive for lawn violations from $550.00 to $250.00. Ty Baden seconded the motion. Ty and Jose voted yes and the motion was passed.
All current violations and their status were reviewed. It was noted that several of the violations were going to be discussed with the HOA attorney.
It was noted that the speed bump sign had been received and that it would be installed within a couple of days in anticipation of the speed bumps being installed this week or next.
Since Brian Starr was not in attendance as of yet, the review of the state of the estates address was tabled indefinitely.
Mike Wasnorowicz noted that the dog breed amendment was on the desk of the HOA attorney and that he would be back from vacation next week. Mike anticipates signing the amendment at that time and subsequently having the amendment filed with the Polk County Clerk’s office.
The declaration was reviewed concerning all legal recourse the HOA has in getting members to comply with that document. It was agreed that the declaration would be reviewed with the HOA attorney to understand what legal recourse the board has in matters of violations of the declaration. It was also agreed to retain an attorney to represent the HOA in the counter-suits filed by Michele Adamson and Kim Beasley.
Jose Arroyo informed the board that several members complaining about a dog at 110 Shaddock Drive had approached him. Jose was asked if the dog was running loose. When he said no, the board agreed that it was not a violation and therefore not a board issue.
Jose Arroyo also informed the board that several members complaining about a car being parked in the street at 101 Shaddock Drive and blocking the entrance had approached him. Mike Wasnorowicz reminded the board that there were no restrictions in the declaration prohibiting parking in the street during the day. He added that parking overnight is restricted by the declaration. Ty Baden suggested that someone speak to the owners at 101 Shaddock to see if the owner of the car could park in the driveway. Mike Wasnorowicz mentioned that the HOA could also define the area on both sides of the street close to the gate as a no parking zone.
Jose Arroyo informed the board that the member at 108 Shaddock had been parking overnight on the street and that he had told the member that was in violation of the declaration. The board agreed that Jose would talk to the homeowner again if he were to continue parking on the street overnight.
Jose Arroyo asked the board to make a decision to allow or not allow the erection of amateur radio antennae. Ty Baden made a motion to deny permission for Jose Arroyo to maintain his radio antennae until he had submitted an Architectural Change Request Form (ACRF) to the board and have the ACRF approved. Mike Wasnorowicz seconded the motion. Ty and Mike voted yes and the motion was passed.
Brian Starr arrived at the meeting at this point.
The state of the estates address was taken off the table for review. Brian informed the board that his address would be ready for the annual members meeting next week.
Brian Starr made a motion to adjourn the meeting. Ty Baden seconded the motion. Everyone voted yes and the meeting was adjourned at 8:40 PM.
