Board Meeting - December 6, 2006

The meeting was called to order at 7:10 P.M. In attendance were Brian Starr, Jose Arroyo, Ty Baden and Mike Wasnorowicz. Also present were Kevin Gervase and Eric Sigismondi.

It was noted that all the board members had read the minutes from the November 2006 board meeting. Brian Starr made a motion to approve the minutes from the November 2006 board meeting. Jose Arroyo seconded the motion. All the board members voted yes and the minutes were approved.

The issue of alternate payment plans for members who are unable to pay their dues in full January 1, 2008 was discussed. Eric Sigismondi claimed that some of the homeowners had approached him with their concerns with the new one payment schedule, but were reluctant to identify themselves. Brian Starr made a motion to send a letter to the membership stating that for this year only, members can pay their annual dues in two installments in the same manner and with the same penalties and the same possibility of a lien as was the policy for the year of 2006. The letter will further state that beginning January 1, 2008, and without exception, the annual dues will be payable in one payment only. Ty Baden seconded the motion. All the board members voted yes and the motion was passed.

The status of each of the current violations was reviewed. It was noted that some of the violators were in the process of being fined and some had defaulted on paying existing fines and that some violators were being sued in small claims court for the non-payment of those fines.

The issue of the speed bumps was discussed. Ty Baden made a motion to order a "caution speed bumps sign" and have the contractor install 6 speed bumps as per Brian Starr’s diagram, two bumps on the Shaddock Drive straight away, one bump between the curve and stop sign on Shaddock, one bump half way between the stop sign and the north cul-de-sac on Evergreen, one bump halfway between the stop sign and the curve going south on Evergreen and one bump on Evergreen halfway between the curve and the south cul-de-sac. Jose Arroyo seconded the motion. All the board members voted yes and the motion was passed.

The issue of installing a "Deed Restricted Community" sign at the front gate was discussed. It was decided to not go ahead with this sign at least for the time being.

The issue of the dog breed amendment was discussed. It was noted that the HOA attorney had found no case law or statutes concerning the method of balloting concerning the amendment of the declaration. Brian Starr made a motion to have the HOA attorney file the dog breed amendment with the county clerk without further balloting. Ty Baden seconded the motion. All the board members voted yes and the motion was passed.

The board’s position concerning the up-coming small claims court actions with the members at 115 Evergreen and 116 Shaddock was discussed. Brian Starr made a motion that Mike Wasnorowicz and he be allowed to represent the HOA in the small claims court mediation proceedings. Ty Baden seconded the motion. All the board members voted yes and the motion was passed. Ty Baden and Jose Arroyo signed a form giving authorization to Mike Wasnorowicz and/or Brian Starr to represent the HOA in these proceedings.

The year of 2006 was reviewed with the intent of giving Brian Starr input for his annual state of the estates address for the members meeting in January 2007.

Brian Starr made a motion to adjourn the meeting. Ty Baden seconded the motion. All the board members voted yes and the meeting was adjourned at 9:00PM.
