Board Meeting - April 4, 2007

The meeting was called to order at 7:08 P.M. In attendance were board members: Brian Starr, Ty Baden, Julie Flowerdew and Mike Wasnorowicz. Members present were Diane Cruz, Bill & Joan Wallace, Tatiana Desamours, Kim Beasley and Eileen Young.

It was noted that Eileen Young would be tape recording the meeting, as would the board.

It was noted that all the board members had read the minutes from the March 2007 board meeting. Brian Starr made a motion to approve the minutes from the March 2007 board meeting. Ty Baden seconded the motion. Ty Baden, Julie Flowerdew and Brian Starr voted yes and the minutes were approved.

An ACR form from Kevin Gervase for replanting his front flowerbeds was reviewed by the board and subsequently approved.

It was noted that there are two legal cases still pending and that they could not be reviewed for legal reasons. It was also noted that the recall petition that was served on the board last August was found to be defective by DBPR. It was further noted that DBPR had not assigned liability for the legal fees and that the HOA attorney had written them a letter asking them to do so.

Insuring the white fence in the front was discussed. Mike Wasnorowicz had contacted the HOA insurance company and received a premium amount of $120 to insure the fence for $15,000. After a brief discussion it was decided to see if there was any way to reduce that premium. Mike Wasnorowicz volunteered to contact the agent again to see what could be done.

It was noted that two of the people who live in the community, who are known to speed through the community, were asked by another member to slow down and that has had no effect.

It was noted that the vehicles parking in front of 101 Shaddock had stopped doing so after the owner was asked to inform his guests not to do so that it caused a dangerous situation.

There was a discussion about posting the gate opening instructions on the keypad at the front gate. It was also noted that the keypad hadn’t always been working lately. It was noted that it might not have been working because of the electric box cover being off for the last few weeks. It was recommended to install a reset switch and a locking box on the outlet. Brian volunteered to look into getting an electrician. Julie Flowerdew volunteered to look into getting a plaque made with the gate operating instructions on it.

There was a discussion about the need for the board to amend the by-laws to allow them to levy fines for violations in the common areas. It was noted that according to the by-laws Article VII, Section 1,the board of directors has the power to "adopt and publish rules and regulations governing the use of the Common Area and facilities, and the personal conduct of the members… and to establish penalties for the infraction thereof". Brian Starr made a motion to allow the board to levy a fine from $25 to $100 for any violation in the common area. Ty Baden seconded the motion. All the board members voted yes and the motion was passed.

Mike Wasnorowicz presented the board with his proposals for the language of the amendments to the declaration the board had decided were needed. After a lengthy discussion, the board accepted most of the amendments’ language. Some of the amendments’ language was thought to need some changes and those will be discussed at the next board meeting.

The floor was opened for new business.

It was noted that the property at 114 Shaddock Drive had not submitted an ACR form for the work being done in that backyard. It was determined that this was in violation of the declaration and a letter should be sent to the member.

It was noted that there are what appear to be concrete forms in the backyard of 104 Shaddock Drive and there is no ACR form, which is a violation of the declaration, and a letter should be sent to the member. It was also noted that there is a tree needing straightening.

It was noted that a petition was submitted to the board asking to amend the declaration to allow 6-foot privacy fences to be allowed. Once the signatures are verified to be correct and that a sufficient number have been submitted, the language for the amendment would be created.

Ty Baden made a motion to adjourn. Brian Starr seconded the motion. Everyone voted yes and the meeting was adjourned at 8:58PM.
